 Introduced  by Sen. PHILLIPS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Judiciary
 
 AN ACT to amend the civil practice law and rules, in relation to actions
   commenced by immediate family members within the zone  of  danger  for
   intentional or negligent infliction of emotional distress

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 215 of the civil practice law and rules is  amended
 by adding a new subdivision 9 to read as follows:
   9.  AN  ACTION BY AN IMMEDIATE FAMILY MEMBER WITHIN THE ZONE OF DANGER
 FOR INTENTIONAL OR NEGLIGENT INFLICTION OF EMOTIONAL DISTRESS.  FOR  THE
 PURPOSES OF THIS SECTION, "IMMEDIATE FAMILY MEMBER" SHALL MEAN A SPOUSE,
 PARENT, CHILD, SIBLING, OR GRANDPARENT.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
