TITLE OF BILL:
An act to amend the education law, in relation to requiring health care
practitioners to provide and the state education department to collect
information about the practice of their professions and in relation to
providing practitioners with information on enrolling in the New York
state donate life registry for organ, eye and tissue donations
PURPOSE:
This bill would facilitate the ability of the Department of Health (DOH)
to collect and make available information about health care practition-
ers, and promote to health care practitioners the opportunity to enroll
in the New York State Donate Life Registry (NYSDLR) for organ, eye and
tissue donation as a means of increasing the number of registrants and
highlighting the critical need for organ donation.
SUMMARY OF PROVISIONS:
Section 1 of the bill would amend Education Law § 6541 to require physi- cian assistants to report information as part of their registration and re-registration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 2 of the bill would amend Education Law § 6548 to require specialist assistants to report information as part of their registra- tion and re-registration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 3 of the bill would amend Education Law § 6554 to require chiro- practors to report information as part of their registration and re-re- gistration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 4 of the bill would amend Education Law § 6604 to require dentists to report information as part of their registration and re-re- gistration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 5 of the bill would amend Education Law § 6608-b to require certified dental assistants to report information as part of their registration and re-registration with SED, which would be shared with DOH. Section 13 of the bill would amend Education Law § 6955 to require midwives to report information as part of their registration and re-re- gistration with SED, which would be shared with DOH. Section 14 of the bill would amend Education Law § 7004 to require podiatrists to report information as part of their registration and re-registration with SED, which would be shared with DOH. Section 15 of the bill would amend Education Law § 7104 to require opto- metrists to report information as part of their registration and re-re- gistration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 16 of the bill would amend Education Law § 7124 to require ophthalmic dispensers to report information as part of their registra- tion and re-registration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 17 of the bill would amend Education Law § 7603 to require psychologists to report information as part of their registration and re-registration with SED, which would be shared with DOH and the Office of Mental Health (OMH). Sections 18 and 19 of the bill would amend Education Law § 7704 to require licensed master social workers and licensed clinical social workers to report information as part of their registration and re-re- gistration with SED, which would be shared with DOH, OMH, the Office of Alcoholism and Substance Abuse Services and any other state agency as appropriate. Sections 33 and 34 of the bill would amend Education Law § 8605 to require clinical laboratory technologists and cytotechnologists to report information as part of their registration and re-registration with SED, which would be shared with DOH. Section 37 of the bill would amend Education Law § 8705 to require professional medical physicists to report information as part of their registration and re-registration with SED, which would be shared with DOH. Sections 38 and 39 of the bill would amend Education Law § 8804 to require certified behavioral analyst assistants and licensed behavior analysts to report information as part of their registration and re-re- gistration with SED, which would be shared with DOH. Section 40 of the bill would amend Education Law § 8852 to require pathologists' assistants to report information as part of their regis- tration and re-registration with SED, which would be shared with DOH. SED also would provide the website address of the NYSDLR. Section 41 provides that the bill would take effect 180 days after enactment. JUSTIFICATION: This bill would facilitate the ability of DOH to collect and make avail- able information about health care practitioners. Currently, DOH collects data on a small number of professions through voluntary surveys administered as part of professional license renewal. However, the rates of responses vary, and information is not sought from all health care practitioners. This bill would require health care practitioners, other than physicians who report information to DOH's Physician Profile pursuant to Public Health Law § 2995-a, to report information, such as the settings where they practice, to the SED as part of their registra- tion and re-registration requirements. SED would collect this informa- tion and provide it to DOH and any other applicable state agency, which would use the information to inform policies and programs related to the health care workforce and also make de-identified, aggregate information available to the public on its website. A model for this proposal is found in Education Law § 6902(3)(e), enacted as part of the 2014-15 budget (Chapter 56 of the Laws of 2014, Part D) which provides that information will be collected by SED from nurse practitioners (NPs) as part of their triennial registration and used by DOH to get a better picture of NPs and their impact on access to care. This information, in de-identified form, will be made available on the DOH website. This bill also would require SED, upon the registration and re-registra- tion of health care practitioners, to provide such practitioners with the website address of the NYSDLR so that they can consider enrolling therein. Organ transplantation is a standard treatment for many condi- tions including end-stage heart, liver and kidney disease, but the demand for donated organs far exceeds the supply. Each day, in the United States, 22 people die waiting for an organ. At present, more than 118,000 people in the United States - approximately 10,000 of them New Yorkers - are waiting for an organ. One individual can save up to eight lives by donating organs and can improve the lives of many others with donated tissues and eyes. Enrolling in the NYSDLR, established pursuant to PHL § 4310, is one means of providing legal consent to organ, eye and tissue donation. Individuals who are at least 16 years of age may enroll in the NYSDLR, provided that consent may be revoked by a parent or legal guardian if the individual is younger than 18 at the time of death. While nearly 4.5 million people are currently enrolled in the NYSDLR, this is less than one-third of the population eligible to enroll. Under this bill, information about the NYSDLR will be provided to health care practitioners upon registration and re-registration with SED. This will not only encourage practitioners to register themselves, but also will urge them to promote the enrollment opportunity to their patients. Ultimately, this initiative could help increase enrollment in the NYSDLR and address this critical population health issue. LEGISLATIVE HISTORY: This is a new bill. FISCAL IMPLICATIONS: None. BLY, DO ENACT AS FOLLOWS:
Section 1. Section 6541 of the education law is amended by adding a
new subdivision 4 to read as follows:

§ 5. Subdivisions 4 and 5 of section 6608-b of the education law,
subdivision 4 as amended by chapter 300 of the laws of 2006 and subdivi-
sion 5 as amended by chapter 565 of the laws of 1995, are amended and a
new subdivision 6 is added to read as follows:
(4) Education and experience: (A) have received a high school diploma,
or its equivalent, and (B) have successfully completed, in accordance
with the commissioner's regulations, (i) an approved one-year course of
study in dental assisting in a degree-granting institution or a board of
cooperative educational services program which includes at least two
hundred hours of clinical experience, or an equivalent approved course
of study in dental assisting in a non-degree granting institution which
shall not be a professional association or professional organization or
(ii) an alternate course of study in dental assisting acceptable to the
department which shall be provided by a degree-granting institution or a
board of cooperative educational services program which includes at
least one thousand hours of relevant work experience; [and]
(5) Examination: pass an examination given by an organization which
administers examinations for certifying dental assistants and which is
acceptable to the department[.]; AND
(6) INFORMATION AND DOCUMENTATION: IN CONJUNCTION WITH AND AS A CONDI-
TION OF EACH TRIENNIAL REGISTRATION, PROVIDE TO THE DEPARTMENT, AND THE
DEPARTMENT SHALL COLLECT, SUCH INFORMATION AND DOCUMENTATION REQUIRED BY
THE DEPARTMENT, IN CONSULTATION WITH THE DEPARTMENT OF HEALTH, AS IS
NECESSARY TO ENABLE THE DEPARTMENT OF HEALTH TO EVALUATE ACCESS TO NEED-

§ 18. Paragraphs (f) and (g) of subdivision 1 of section 7704 of the
education law, paragraph (f) as added by chapter 420 of the laws of 2002

laws of 2005, are amended and a new paragraph (h) is added to read as
follows:
(f) Character: be of good moral character as determined by the depart-
ment; [and]
(g) Fees: pay a fee of one hundred fifteen dollars to the department
for an initial license, and a fee of one hundred fifty-five dollars for
each triennial registration period. An additional surcharge in the
amount of five dollars shall be paid with each triennial registration
fee and shall be used for the marketing and evaluation of the regents
licensed social worker loan forgiveness program established by section
six hundred five of this chapter[.]; AND

§ 20. Subdivisions 6 and 7 of section 7804 of the education law, as

for admission to a department conducted examination and for an initial
license, a fee of forty-five dollars for each reexamination, a fee of

§ 21. Section 7904 of the education law is amended by adding a new
subdivision 9 to read as follows:

registration period that shall be one-half of the fee for initial
license and for each triennial registration period established for occu-

ty-nine hundred seven of this article, pass an examination acceptable to

TION, PROVIDE TO THE DEPARTMENT, AND THE DEPARTMENT SHALL COLLECT, SUCH
INFORMATION AND DOCUMENTATION REQUIRED BY THE DEPARTMENT, IN CONSULTA-
TION WITH THE DEPARTMENT OF HEALTH, AS IS NECESSARY TO ENABLE THE
DEPARTMENT OF HEALTH TO EVALUATE ACCESS TO NEEDED SERVICES IN THIS
STATE, INCLUDING, BUT NOT LIMITED TO, THE LOCATION AND TYPE OF SETTING
WHEREIN THE OCCUPATIONAL THERAPY ASSISTANT PRACTICES AND OTHER INFORMA-

§ 29. Paragraphs (f) and (g) of subdivision 3 of section 8404 of the
education law, paragraph (f) as added by chapter 676 of the laws of 2002
and paragraph (g) as amended by chapter 210 of the laws of 2004, are
amended and a new paragraph (h) is added to read as follows:
(f) Character: Be of good moral character as determined by the depart-

FIED FORM ON A PUBLICLY ACCESSIBLE WEBSITE. ADDITIONALLY, IN CONJUNCTION
WITH EACH TRIENNIAL REGISTRATION, THE DEPARTMENT, IN CONSULTATION WITH
THE DEPARTMENT OF HEALTH, SHALL PROVIDE INFORMATION ON REGISTERING IN

THE DONATE LIFE REGISTRY FOR ORGAN AND TISSUE DONATION, INCLUDING THE
WEBSITE ADDRESS FOR SUCH REGISTRY.
§ 40. Section 8852 of the education law is amended by adding a new
subdivision 7 to read as follows:
7. INFORMATION AND DOCUMENTATION: IN CONJUNCTION WITH AND AS A CONDI-
TION OF EACH TRIENNIAL REGISTRATION, THE DEPARTMENT SHALL COLLECT AND A
PATHOLOGIST ASSISTANT SHALL PROVIDE SUCH INFORMATION AND DOCUMENTATION
REQUIRED BY THE DEPARTMENT, IN CONSULTATION WITH THE DEPARTMENT OF
HEALTH, AS IS NECESSARY TO ENABLE THE DEPARTMENT OF HEALTH TO EVALUATE
ACCESS TO NEEDED SERVICES IN THIS STATE, INCLUDING, BUT NOT LIMITED TO,
THE LOCATION AND TYPE OF SETTING WHEREIN THE PATHOLOGISTS' ASSISTANT
PRACTICES AND OTHER INFORMATION THE DEPARTMENT, IN CONSULTATION WITH THE
DEPARTMENT OF HEALTH, DEEMS RELEVANT. THE DEPARTMENT OF HEALTH, IN
CONSULTATION WITH THE DEPARTMENT, SHALL MAKE SUCH DATA AVAILABLE IN
AGGREGATE, DE-IDENTIFIED FORM ON A PUBLICLY ACCESSIBLE WEBSITE. ADDI-
TIONALLY, IN CONJUNCTION WITH EACH TRIENNIAL REGISTRATION, THE DEPART-
MENT, IN CONSULTATION WITH THE DEPARTMENT OF HEALTH, SHALL PROVIDE
INFORMATION ON REGISTERING IN THE DONATE LIFE REGISTRY FOR ORGAN AND
TISSUE DONATION, INCLUDING THE WEBSITE ADDRESS FOR SUCH REGISTRY.
§ 41. This act shall take effect on the one hundred eightieth day
after it shall have become a law; provided, however, that section forty
of this act shall take effect on the same date and in the same manner as
section one of chapter 497 of the laws of 2016, takes effect.
