 Introduced  by  Sen. ADDABBO -- read twice and ordered printed, and when
   printed to be committed to the Committee on Agriculture
 
 AN ACT to amend the agriculture and markets law, in relation to limiting
   licensing to only pet dealers which sell animals obtained  from  shel-
   ters and rescue organizations
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 403 of the agriculture and markets law  is  amended
 by adding a new subdivision 12 to read as follows:
   12.  NO  PET  DEALER  SHALL  DISPLAY,  SELL,  DELIVER, OFFER FOR SALE,
 BARTER, AUCTION, GIVE AWAY, BROKER OR OTHERWISE TRANSFER OR  DISPOSE  OF
 AN ANIMAL UNLESS IT IS OBTAINED FROM:
   (A) AN ANIMAL SHELTER;
   (B)  A  PRIVATE,  NONPROFIT  HUMANE SOCIETY OR NONPROFIT ANIMAL RESCUE
 ORGANIZATION; OR
   (C) AN ANIMAL SHELTER, NONPROFIT HUMANE SOCIETY  OR  NONPROFIT  ANIMAL
 RESCUE  ORGANIZATION  THAT  OPERATES  OUT OF OR IN CONNECTION WITH A PET
 DEALER.
   NOTHING SHALL PREVENT A PET DEALER FROM PROVIDING SPACE AND  APPROPRI-
 ATE CARE FOR ANIMALS OWNED BY AN ANIMAL SHELTER, NONPROFIT HUMANE SOCIE-
 TY  OR NONPROFIT ANIMAL RESCUE AGENCY AND MAINTAINED BY A PET DEALER FOR
 THE PURPOSE OF ADOPTING THOSE ANIMALS TO THE PUBLIC.
   § 2. This act shall take effect on the sixtieth  day  after  it  shall
 have become a law.
