TITLE OF BILL:  An act to amend the vehicle and traffic law, in
relation to offsetting publicly available parking spaces replaced by
designated bus lanes or removed by capital projects in the city of New
York and requiring a public hearing to be held prior to eliminating such
parking spaces

 
PURPOSE:

To require the City of New York provide an equal number of parking spots
to the number of spots which are eliminated in order to accommodate an
SBS lane

 
SUMMARY OF PROVISIONS:

Section 1 Amends Section 1111-C of the Vehicle and Traffic Law to add a
new subdivision (M) to require that the City of New York dedicate an
equal quantity of publicly available parking spots within a one block
radius for each parking spot that is eliminated or removed by a desig-

nated bus lane. The City of New York must convene no less than one
public hearing within the bounds of the community board affected, no
less than thirty days prior to consider alternative parking placements.
The City of New York would also have to provide a minimum of fourteen
days notice prior to the public hearing, in a local newspaper, public
buildings and on the agency responsible for the project.

Section 2 Amends subdivision 2 of Section 1642 of the Vehicle and Traf-
fic Law to require that the City of New York convene no less than one
public hearing within the bounds of the community board affected, no
less than thirty days prior to consider alternative parking placements.
The City of New York would also have to provide a minimum of fourteen
days notice prior to the public hearing, in a local newspaper, public
buildings and on the agency responsible for the project.

 
JUSTIFICATION:

Many local businesses across New York City depend on access to parking.
When the introduction of a Select Bus Service (SBS) is created at the
expense of parking spots, it is the local businesses and residents who
are negatively impacted. Parking spots are already at premium in New
York City, so the removal of additional spots to accommodate SBS lanes
would be devastating to local businesses who are already struggling with
fierce online competition. Small businesses rely on accessible parking
for their customers and their removal would further hurt customer access
to these businesses.

This legislation would mandate that any parking spots which are removed
to accommodate an SBS lane, that the City of New York must provide the
same number of parking spots within a one block radius.

 AN ACT to amend the vehicle and traffic law, in relation  to  offsetting
   publicly  available parking spaces replaced by designated bus lanes or
   removed by capital projects in the city of New York  and  requiring  a
   public hearing to be held prior to eliminating such parking spaces
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 1111-c of the vehicle and traffic law is amended by
 adding a new subdivision (n) to read as follows:
   (N) 1. THE CITY OF NEW  YORK  SHALL  OFFSET  EACH  PUBLICLY  AVAILABLE
 COMMERCIAL  OR  RESIDENTIAL  PARKING  SPACE REPLACED BY A DESIGNATED BUS
 LANE IN ANY BUS RAPID TRANSIT PROGRAM ROUTE IMPLEMENTED  AFTER  NOVEMBER
 FIRST, TWO THOUSAND SEVENTEEN BY DEDICATING AN EQUAL QUANTITY OF PUBLIC-
 LY AVAILABLE COMMERCIAL OR RESIDENTIAL PARKING SPACES WITHIN A ONE BLOCK
 RADIUS FOR EACH PARKING SPACE THAT IS ELIMINATED OR REMOVED.
   2.  PRIOR TO ELIMINATING OR REMOVING ANY PUBLICLY AVAILABLE COMMERCIAL
 OR RESIDENTIAL PARKING SPACE, THE CITY OF NEW YORK SHALL CONVENE NO LESS
 THAN ONE PUBLIC  HEARING  WITHIN  THE  BOUNDS  OF  THE  COMMUNITY  BOARD
 AFFECTED NO LESS THAN THIRTY DAYS PRIOR TO SUCH DETERMINATION TO CONSID-
 ER  ALTERNATIVE PARKING REPLACEMENTS. THE CITY OF NEW YORK SHALL PROVIDE
 A MINIMUM OF FOURTEEN DAYS' NOTICE BEFORE EACH HEARING BY PLACING NOTICE
 IN A NEWSPAPER AND ON THE WEBSITE OF A  NEWSPAPER  THAT  HAS  A  GENERAL
 CIRCULATION  IN THE GEOGRAPHIC AREA, BY POSTING A COPY OF SUCH NOTICE IN
 NOT LESS THAN FIVE PUBLIC PLACES IN THE IMPACTED AREA, AND PLACING  SUCH
 NOTICE  IN A PROMINENT LOCATION ON THE PUBLIC WEBSITE OF THE AGENCY WITH
 PRIMARY RESPONSIBILITY FOR MANAGING THE PROJECT.
   § 2. Paragraph 2 of subdivision (a) of section 1642 of the vehicle and
 traffic law is amended to read as follows:
   2. (I) Parking, standing, stopping and backing of vehicles;  PROVIDED,
 HOWEVER,  THAT ANY CITY HAVING A POPULATION OF ONE MILLION OR MORE SHALL
 DEDICATE AN EQUAL QUANTITY OF PUBLICLY AVAILABLE COMMERCIAL OR  RESIDEN-
 TIAL  PARKING  SPACES  FOR EACH PARKING SPACE ELIMINATED OR REMOVED BY A
 CAPITAL PROJECT INITIATED AFTER NOVEMBER FIRST, TWO THOUSAND SEVENTEEN.

 the amendments to section 1111-c of the vehicle and traffic law made  by
 section  one of this act shall not affect the repeal of such section and
 shall be deemed repealed therewith.
