AN ACT to amend the education law, in relation to creating the State
University of New York Teachers' College
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The education law is amended by adding a new article 116 to
read as follows:

§ 5800. COLLEGE CREATED. THE UNIVERSITY OF THE STATE OF NEW YORK
TEACHERS' COLLEGE IS HEREBY CREATED, AND SHALL BE ESTABLISHED IN ALBANY,
NEW YORK. THE COLLEGE SHALL BE SUBJECT TO THE SUPERVISION OF THE STATE
UNIVERSITY TRUSTEES.
§ 5801. OBJECTS AND PURPOSES. THE COLLEGE SHALL HAVE AS ITS OBJECTS
AND PURPOSES:
1. TEACHING IN THE ART AND PRACTICE OF THE TEACHING SCIENCE IN ITS
VARIOUS CAPACITIES INCLUDING THE CULTIVATION OF THE ARTS, LITERATURE,
AND THE VARIOUS SCIENCES; EARLY CHILDHOOD EDUCATION; ELEMENTARY EDUCA-
TION; SECONDARY EDUCATION; LANGUAGE TRAINING; SPECIAL NEEDS EDUCATION;
LESSON CREATION; CLASSROOM MANAGEMENT; CLASSROOM TECHNOLOGY IMPLEMENTA-
TION AND USE; EXAM CREATION AND GRADING; CURRICULA MANAGEMENT AND IMPLE-
MENTATION; CHILD DEVELOPMENT; ADOLESCENT DEVELOPMENT; AND THE SUBJECTS
DEEMED NECESSARY BY THE BOARD OF REGENTS FOR THE EDUCATION OF STATE
PUBLIC SCHOOL STUDENTS.
2. THE CONDUCT OF RESEARCH AND EXPERIMENTATION IN MODERN TEACHING
TECHNIQUES.

3. THE INSTRUCTION OF STUDENTS IN THE WAYS AND METHODS OF CULTURALLY
AND SOCIALLY SENSITIVE TEACHING, AS TO ENCOURAGE THE DISSEMINATION OF
THIS SENSITIVITY INTO SCHOOLS AND CREATE SCHOOL ENVIRONMENTS WHERE ALL
STUDENTS ARE WELCOME.
4. THE TRAINING OF ALL ITS MATRICULATES IN THE TEACHING OF SPECIAL
NEEDS STUDENTS, THROUGH CURRICULA DEVELOPED AND APPROVED BY THE OFFICE
OF SPECIAL EDUCATION.
5. THE TRAINING OF ALL WILLING MATRICULATES IN PROMINENT LANGUAGES OF
THE STATE, INCLUDING BUT NOT NECESSARILY LIMITED TO, ENGLISH AND SPAN-
ISH, AND THE METHODS AND PRACTICES OF BILINGUAL EDUCATION.
6. THE CREATION AND ESTABLISHMENT OF TEACHER RESIDENCY PROGRAMS IN
VARIOUS PUBLIC SCHOOLS ACROSS THE STATE, FOR THE PURPOSE OF PROVIDING
IN-CLASSROOM TRAINING FOR THE COLLEGE'S GRADUATE LEVEL STUDENTS.
7. THE LIBERAL AND COMPREHENSIVE TRAINING AND EDUCATION OF TEACHERS,
AND TO PROGRESS THE TEACHING PROFESSION IN ALL ITS FORMS.
§ 5802. ADVISORY BOARD; APPOINTMENT; POWER AND DUTIES. AN ADVISORY
BOARD SHALL BE CREATED AND CONSIST OF ELEVEN MEMBERS: TWO APPOINTED BY
THE COMMISSIONER, TWO BY THE BOARD OF REGENTS, TWO BY THE FACULTY AND/OR
PROFESSIONAL STAFF FROM NEW YORK STATE UNIVERSITIES WHO ARE TO BE CHOSEN
FROM NEW YORK STATE UNIVERSITIES WITH EXEMPLARY EDUCATION TRAINING
PROGRAMS, TWO FROM AMONG THE COLLEGE'S FACULTY TO BE CHOSEN BY A VOTE OF
THE MATRICULATES, AND THREE ARE TO BE CHOSEN FROM AMONG WILLING STATE
PUBLIC SCHOOL TEACHERS BY A JOINT LEGISLATIVE COMMITTEE ON HIGHER EDUCA-
TION. THE MEMBERS APPOINTED SHALL SERVE THREE-YEAR TERMS WHEN APPOINTED
IN ODD-NUMBERED YEARS, AND TWO-YEAR TERMS WHEN APPOINTED IN EVEN-NUM-
BERED YEARS. ADVISORY BOARD MEMBERS MAY BE REMOVED BY A TWO-THIRDS VOTE
OF ALL OTHER ADVISORY BOARD MEMBERS, OR BY A TWO-THIRDS VOTE OF THE
SENATE. VACANCIES OCCURRING ON THE ADVISORY BOARD FOR ANY REASON SHALL
BE FILLED BY THE AUTHORITY VESTED WITH THE POWER TO MAKE THE ORIGINAL
APPOINTMENT. THE ADVISORY BOARD SHALL, FROM AMONG ITS MEMBERS, APPOINT A
CHAIRPERSON, VICE-CHAIRPERSON AND SECRETARY. THE MEMBERS OF THE ADVISORY
BOARD WILL BE REIMBURSED FOR ACTUAL AND NECESSARY EXPENSES INCURRED
THROUGH THE DISCHARGE OF THEIR ADVISORY DUTIES, BUT SHALL NOT OTHERWISE
BE COMPENSATED. THE ADVISORY BOARD SHALL MEET AT LEAST FOUR TIMES EACH
YEAR, FOR THE PURPOSE OF GOVERNING THE OPERATION OF THE COLLEGE, REVIS-
ING ITS GOALS, AND ESTABLISHING ITS PLANS FOR ACHIEVING THOSE GOALS.
THE ADVISORY BOARD, LESS THE MATRICULATE-APPOINTED MEMBERS, SHALL AFTER
STUDY AND CONSULTATION OF APPROPRIATE AUTHORITIES, SUBMIT TO THE COMMIS-
SIONER, BOARD OF REGENTS, THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE
SENATE AND THE SPEAKER OF THE ASSEMBLY, ITS OFFICIAL RECOMMENDATION FOR
THE ORGANIZATION, STRUCTURE, ADMINISTRATION, OPERATION AND ACTIVITIES OF
THE COLLEGE. SUCH REPORT SHALL BE COMPLETED ON OR BEFORE JANUARY FIRST,
TWO THOUSAND TWENTY. SUBSEQUENT REPORTS BY THE FULL ADVISORY BOARD WILL
BE COMPLETED AND SUBMITTED IN THE SAME FASHION EVERY FIVE YEARS. THE
ADVISORY BOARD SHALL ALSO, WITH THE DEPARTMENT, PUBLISH AN ANNUAL REPORT
OF THE STATE OF THE TEACHING PROFESSION IN THE STATE, INCLUDING, BUT NOT
LIMITED TO: TEACHER SHORTAGES, VACANCIES IN INDIVIDUAL DISTRICTS,
LEGISLATION THAT HAS PASSED IN THE SENATE AND/OR ASSEMBLY WHICH AFFECTS
THE TEACHING PROFESSION, IMPLICATIONS OF THE STATE BUDGET ON SCHOOLS AND
THE TEACHING PROFESSION, AND REGIONAL DATA ON TEACHER PAY.
§ 5803. PROPERTY TO BELONG TO STATE. ALL REAL PROPERTY ACQUIRED VIA
STATE-APPROPRIATED MONIES SHALL BE AND REMAIN THE PROPERTY OF THE STATE.
IF THE PROPERTY IS PURCHASED, THE TITLE THERETO SHALL BE CONVEYED TO THE
PEOPLE OF THE STATE, THE SUFFICIENCY OF SUCH CONVEYANCE BEING SUBJECT TO
APPROVAL BY THE ATTORNEY GENERAL.

§ 5804. TUITION AND FEES; CONDITIONS. THROUGH APPROPRIATIONS OF THE
STATE, THE COLLEGE WILL NOT COLLECT OR SOLICIT TUITION OR FEES FROM ITS
MATRICULATES FOR TUITION, BOARD IN COLLEGE-OWNED HOUSING, OR COURSE
ENROLLMENT. THE COLLEGE MAY CHARGE AND COLLECT FEES FOR HEALTH SERVICES,
EXTRACURRICULAR STUDENT ACTIVITIES, DINING, AND ANY OTHER FEES OF NOMI-
NAL RELATIVE VALUE, IF SO APPROVED BY A UNANIMOUS VOTE OF ITS ADVISORY
BOARD.
§ 5805. CONDITIONS OF MATRICULATION. STUDENTS WHO SATISFACTORILY
COMPLETE THE PRESCRIBED UNDERGRADUATE AND GRADUATE EDUCATION PROVIDED BY
THE COLLEGE WILL BE REQUIRED TO TEACH AT A STATE PUBLIC SCHOOL FOR A
CONTINUOUS FIVE-YEAR PERIOD WITHIN TEN YEARS OF RECEIVING HIS OR HER
DEGREE THROUGH THE COLLEGE. STATE PUBLIC SCHOOLS WITH UNREACHED TEACHER
CAPACITY AND PUBLIC SCHOOLS WITH HIGH PERCENTAGES OF HIGH-NEED OR LOW-
INCOME STUDENTS WILL BE GIVEN PREFERENCE IN THE PLACEMENT OF SUCCESSFUL
COLLEGE GRADUATES. THIS SERVICE SHALL BE CONSIDERED FULL REPAYMENT OF
THE COSTS INCURRED BY THE STUDENT'S EDUCATION AT THE COLLEGE. STUDENTS
WHO DO NOT SATISFACTORILY COMPLETE THE COLLEGE'S PROGRAM OF TEACHING AND
EDUCATION WILL BE REQUIRED TO REPAY A LOAN AMOUNT TO THE STATE EQUAL TO
THE AMOUNT INCURRED THROUGH THEIR EDUCATION AT THE COLLEGE.
§ 5806. DEBT TRANSITION. AS UNDER THE PROVISIONS OF PART TWO OF ARTI-
CLE FOURTEEN OF THIS CHAPTER, THERE SHALL BE A LOAN FORGIVENESS PROGRAM
CREATED AND MADE AVAILABLE TO ALL PRACTICING TEACHERS IN THE STATE, FOR
THE PURPOSE OF MITIGATING THE FINANCIAL BURDEN OF OBTAINING A DEGREE AND
CERTIFICATION NECESSARY TO TEACH IN THE STATE. TO BE ELIGIBLE FOR AN
AWARD, APPLICANTS SHALL HAVE BEEN CERTIFIED AND EMPLOYED AS A TEACHER IN
THE STATE, SHALL HAVE INCURRED EDUCATIONAL DEBT IN THE PURSUIT OF SUCH A
DEGREE AND CERTIFICATION, AND SHALL HAVE AN OUTSTANDING STUDENT LOAN
DEBT. THE AMOUNT OF THE AWARD WILL BE MEANS-TESTED TO THE EXTENT THAT
THE COMMISSIONER DEEMS NECESSARY, AND GIVE PREFERENCE TO THOSE APPLI-
CANTS WHOSE COST OF LIVING ACCOUNTS FOR MORE THAN ONE-THIRD OF THEIR
ANNUAL TEACHING SALARY, AND TO THOSE WHO ARE ECONOMICALLY DISADVANTAGED,
AS DEFINED BY THE COMMISSIONER. THE STATE WILL COUNT THE TOTAL AMOUNT OF
ITS AWARDS AS STATE-OWNED DEBT, OR CANCEL SUCH DEBT AS IS POSSIBLE, AND
MAKE APPROPRIATIONS NECESSARY IN THE FOLLOWING FISCAL YEAR TO REPAY THAT
DEBT.
§ 2. This act shall take effect immediately.
