S T A T E O F N E W Y O R K ________________________________________________________________________ 7840 2017-2018 Regular Sessions I N A S S E M B L Y May 16, 2017 ___________ Introduced by M. of A. SKOUFIS -- read once and referred to the Commit- tee on Local Governments AN ACT authorizing alienation of certain parklands in the town of Corn- wall, county of Orange THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subject to the provisions of this act, the town of Corn- wall, in the county of Orange, acting by and through its town board, is hereby authorized to discontinue as parklands and alienate the lands described in section three of this act, and to sell and convey such parkland at fair market value for the purpose of constructing a local history museum owned and operated by the town of Cornwall. § 2. The authorization contained in section one of this act shall be conditioned upon use of the lands described in section three of this act exclusively for the purpose of construction and operation of a local history museum by the town of Cornwall and, in the event that such use of the said land by the town shall cease, the lands described in section three of this act shall revert to parkland owned and maintained by the town. § 3. The lands authorized by section one of this act to be discontin- ued as parkland are described as follows: ALL that certain plot, piece or parcel of land with the building and improvements thereon erected, situate, lying and being in the Town of Cornwall, County of Orange and State of New York bounded and described as follows: BEGINNING at a point in or near a utility pole at the southeasterly corner of lands of the Central School District No. 1 of the Towns of Cornwall, New Windsor and Woodbury as described in Liber 4750, Page 330, said point of beginning being located South 33 degrees 36 minutes 27 seconds East for a distance of 342.24 feet along the northeasterly EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Subject to the provisions of this act, the town of Corn- wall, in the county of Orange, acting by and through its town board, is hereby authorized to discontinue as parklands and alienate the lands described in section three of this act for the purpose of constructing a local history museum owned and operated by the town of Cornwall. § 2. The authorization contained in section one of this act shall take effect only upon the condition that the town of Cornwall dedicate an amount equal to or greater than the fair market value of the parcel described in section four of this act for the acquisition of additional park and recreational facilities and/or for capital improvements to existing park and recreational facilities. § 3. The authorization contained in section one of this act shall be conditioned upon use of the lands described in section four of this act exclusively for the purpose of construction and operation of a local history museum by the town of Cornwall and, in the event that such use of the said land by the town shall cease, the lands described in section three of this act shall revert to parkland owned and maintained by the town. § 4.
