 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   requiring  the  commissioner  of  environmental  conservation to place
   certain air quality monitoring systems within a one-half  mile  radius
   of  all  waste  transfer stations located within a city having a popu-
   lation of one million or more
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The environmental conservation law is amended by adding a
 new section 19-0322 to read as follows:
 § 19-0322. AIR QUALITY MONITORING SYSTEMS  REQUIRED  WITHIN  A  ONE-HALF
              MILE  RADIUS  OF  ALL WASTE TRANSFER STATIONS WITHIN A CITY
              HAVING A POPULATION OF ONE MILLION OR MORE.
   1. THE COMMISSIONER SHALL PLACE AND OPERATE  AN  AMBIENT  AIR  QUALITY
 MONITOR  NETWORK  WITHIN  A  ONE-HALF  MILE RADIUS OF ALL WASTE TRANSFER
 STATIONS IN CITIES HAVING A POPULATION  OF  ONE  MILLION  OR  MORE.  THE
 NETWORK  SHALL  CONTINUOUSLY  MEASURE  DATA  FOR  OZONE, SULFUR DIOXIDE,
 OXIDES OF NITROGEN, CARBON DIOXIDE, METEOROLOGICAL DATA, PM 1.0  AND  PM
 2.5. THE NETWORK SHALL ALSO INCLUDE AN AUTOMATED DATA ACQUISITION SYSTEM
 EMPLOYED  TO  POLL  THE  SITES  TO RETRIEVE READINGS INTO A CENTRAL DATA
 MANAGEMENT SYSTEM. THE DATA SHALL UNDERGO VERIFICATION AND VALIDATION BY
 A SUPERVISING SITE  ENGINEER  WHICH  SHALL  FOLLOW  ESTABLISHED  QUALITY
 ASSURANCE AND QUALITY CONTROL PROCEDURES.
   2. THE COMMISSIONER SHALL PLACE AND OPERATE A PHOTOCHEMICAL ASSESSMENT
 MONITORING  STATION  AND A NATIONAL AMBIENT TOXIC TREND STATION WITHIN A
 ONE-HALF MILE RADIUS OF ALL WASTE TRANSFER  STATIONS  LOCATED  WITHIN  A
 CITY  HAVING  A  POPULATION  OF ONE MILLION OR MORE. SUCH STATIONS SHALL
 MONITOR VOLATILE ORGANIC COMPOUNDS AS OZONE PRECURSORS DURING THE SUMMER
 OZONE SEASON FOR THE PURPOSE OF DETERMINING THE QUALITY OF  AMBIENT  AIR

 AN  ACT  to direct the department of environmental conservation to adopt
   rules and regulations requiring  permitees  to  place  air  monitoring
   equipment near permitted waste transfer stations
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  No later than January 1, 2020, the department of  environ-
 mental  conservation shall adopt rules and regulations requiring permit-
 tees to place air monitoring equipment at an appropriate  distance  from
 permitted  waste  transfer  stations  to  measure data for ozone, sulfur
 dioxide, oxides of nitrogen, carbon dioxide, meteorological data, PM 1.0
 and PM 2.5. Such regulations shall also require the monitoring of  vola-
 tile  organic  compounds  as  ozone precursors during the summer for the
 purposes of determining  the  quality  of  ambient  air  and  developing
 programs to target appropriate source categories for emission reduction.
 Resulting air quality data shall be required to be made available to the
 department and the public and posted on the department's website.
   §  2. This act shall take effect one year after it shall have become a
 law.
