 AN ACT to amend the education law, in  relation  to  enacting  "Jacobe's
   law"
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. This act shall be known and may be cited as "Jacobe's law."
   § 2. The education law is amended by adding a new section 15-a to read
 as follows:
   § 15-A. REPORTING BY SCHOOL ADMINISTRATORS. 1. SCHOOL  ADMINISTRATORS,
 AS  DEFINED  BY SUBDIVISION SIX OF SECTION ELEVEN HUNDRED TWENTY-FIVE OF
 THIS TITLE, SHALL MAKE A GOOD FAITH EFFORT  TO  CONTACT  THE  PARENT  OR
 GUARDIAN  OF  A  STUDENT  IMMEDIATELY  FOLLOWING A REPORT OF BULLYING OR
 HARASSMENT OR A REASONABLE CAUSE TO SUSPECT AN INCIDENT OF  BULLYING  OR
 HARASSMENT  OF  THE  STUDENT.  "HARASSMENT"  AND  "BULLYING"  SHALL MEAN
 HARASSMENT AND BULLYING AS DEFINED UNDER SUBDIVISION  SEVEN  OF  SECTION
 ELEVEN OF THIS ARTICLE.
   2.  THE  SCHOOL  ADMINISTRATOR SHALL CONTACT THE PARENT OR GUARDIAN BY
 TELEPHONE, ELECTRONIC MAIL, REGULAR MAIL OR OTHER MEANS.
   § 3. This act shall take effect immediately.

 AN  ACT  to  amend  the education law, in relation to enacting "Jacobe's

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. This act shall be known and may be cited as "Jacobe's law."
   § 2. The education law is amended by adding a new section 15-a to read
 as follows:
   §  15-A. REPORTING BY SCHOOL ADMINISTRATORS. 1. SCHOOL ADMINISTRATORS,
 OR THE SCHOOL EMPLOYEE CHARGED WITH  RECEIVING  REPORTS  OF  HARASSMENT,
 BULLYING  AND  DISCRIMINATION,  SHALL  MAKE  A REASONABLE AND GOOD FAITH
 EFFORT TO CONTACT THE PARENTS OR GUARDIANS OF THE STUDENTS  INVOLVED  IN
 AN  INCIDENT  OF  BULLYING  OR HARASSMENT AFTER VERIFYING, IN ACCORDANCE
 WITH THE PROVISIONS OF THIS ARTICLE, THAT SUCH INCIDENT HAS OCCURRED.
   2. THE SCHOOL ADMINISTRATOR SHALL CONTACT THE PARENT  OR  GUARDIAN  BY
 TELEPHONE, ELECTRONIC MAIL, REGULAR MAIL OR OTHER MEANS.
   3. AS USED IN THIS SECTION:
   A.  "SCHOOL  ADMINISTRATOR"  SHALL  HAVE  THE SAME MEANING AS THE TERM
 DEFINED BY SUBDIVISION SIX OF SECTION ELEVEN HUNDRED TWENTY-FIVE OF THIS
 TITLE;
   B. "SCHOOL EMPLOYEE" SHALL HAVE THE SAME MEANING AS SPECIFIED IN PARA-
 GRAPH A OF SUBDIVISION ONE OF SECTION THIRTEEN OF THIS ARTICLE; AND
   C. "HARASSMENT" AND "BULLYING" SHALL HAVE THE SAME MEANING AS  DEFINED
 UNDER SUBDIVISION SEVEN OF SECTION ELEVEN OF THIS ARTICLE.
   § 3. This act shall take effect immediately.

 REASONABLE AND GOOD FAITH EFFORT TO CONTACT THE PARENTS OR GUARDIANS  OF
 THE  STUDENTS  INVOLVED  IN  AN INCIDENT OF BULLYING OR HARASSMENT AFTER
 VERIFYING, IN ACCORDANCE WITH THE PROVISIONS OF THIS ARTICLE, THAT  SUCH
 INCIDENT HAS OCCURRED.
   2.  THE  SCHOOL EMPLOYEE SHALL CONTACT THE PARENT OR GUARDIAN BY TELE-
 PHONE, ELECTRONIC MAIL, REGULAR MAIL OR OTHER MEANS.
   3. AS USED IN THIS SECTION:
   A. "SCHOOL EMPLOYEE" SHALL MEAN THE PRINCIPAL, SUPERINTENDENT  OR  THE
 PRINCIPAL'S  OR  SUPERINTENDENT'S DESIGNEE WHO IS CHARGED WITH RECEIVING
 REPORTS OF HARASSMENT, BULLYING AND DISCRIMINATION  IN  ACCORDANCE  WITH
 PARAGRAPH A OF SUBDIVISION ONE OF SECTION THIRTEEN OF THIS ARTICLE.
   B.  "HARASSMENT" AND "BULLYING" SHALL HAVE THE SAME MEANING AS DEFINED
 UNDER SUBDIVISION SEVEN OF SECTION ELEVEN OF THIS ARTICLE.
   § 3. This act shall take effect immediately.

 REPORTED   INCIDENT   OF  HARASSMENT,  BULLYING  OR  DISCRIMINATION  HAS
 OCCURRED.
   2. WHEN THE INVESTIGATION REVEALS  VERIFIED  HARASSMENT,  BULLYING  OR
 DISCRIMINATION, A SCHOOL COUNSELOR OR OTHER PUPIL PERSONNEL PROFESSIONAL
 SHALL  DISCUSS  WITH  THE STUDENTS INVOLVED WHETHER THEY HAVE ANY HEALTH
 AND SAFETY OR PRIVACY CONCERNS WITH THE SCHOOL'S REQUIREMENT TO  MAKE  A
 REASONABLE  AND GOOD FAITH EFFORT TO CONTACT THEIR PARENTS OR ANY PERSON
 IN PARENTAL RELATION. ANY DISCUSSIONS RESULTING FROM  THE  PROVISION  OF
 THIS SUBDIVISION SHALL BE IMMEDIATELY DOCUMENTED BY THE SCHOOL COUNSELOR
 OR OTHER PUPIL PERSONNEL PROFESSIONAL.
