L. ROSENTHAL -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to the distribution of information to patients at high risk of developing lymphedema THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2803-v to read as follows: § 2803-V. LYMPHEDEMA INFORMATION DISTRIBUTION. 1. FOR THE PURPOSES OF THIS SECTION, THE TERM "LYMPHEDEMA" SHALL MEAN AN ACCUMULATION OF FLUID IN THE INTERSTITIAL TISSUE THAT CAUSES SWELLING, MOST OFTEN IN THE ARMS AND/OR LEGS, AND OCCASIONALLY IN OTHER PARTS OF THE BODY, FROM ANY CAUSE. 2. THE COMMISSIONER SHALL DESIGN AN INFORMATIONAL PACKET ABOUT LYMP- HEDEMA AND SHALL REQUIRE THAT EVERY HOSPITAL OR GENERAL HOSPITAL DISTRIBUTE SUCH PACKET TO ALL PATIENTS AT HIGH RISK OF DEVELOPING LYMP- HEDEMA. PATIENTS AT HIGH RISK SHALL INCLUDE, BUT NOT BE LIMITED TO: (A) PATIENTS WHO HAVE HAD THEIR LYMPH NODES REMOVED OR THEIR LYMPHATIC SYSTEM DAMAGED DURING CANCER TREATMENT; (B) VETERANS INJURED IN COMBAT; (C) PATIENTS WHO HAVE ENDURED PHYSICAL TRAUMA; AND (D) PARENTS OR GUARDIANS OF ANY CHILD WHO EXPERIENCES SWELLING OR DEFORMATION IN INFANCY. § 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
