 AN  ACT  to amend the public service law, in relation to customer choice
   for electricity and natural gas commodity supply services
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 66 of the public service law is amended by adding a
 new subdivision 29 to read as follows:
   29. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, REQUIRE THAT
 ALL  CUSTOMERS  OF  ELECTRIC  CORPORATIONS  AND NATURAL GAS CORPORATIONS
 SHALL HAVE THE OPPORTUNITY TO PURCHASE ELECTRICITY SERVICES AND  NATURAL
 GAS  SERVICES FROM ANY SUPPLIER OF ELECTRICITY AND NATURAL GAS; AND THAT
 ANY ELECTRIC CORPORATION AND NATURAL GAS CORPORATION SHALL PROVIDE TRAN-
 SMISSION AND DISTRIBUTION SERVICES FROM ANY SUPPLIER OF ELECTRICITY  AND
 NATURAL  GAS  TO  ANY CUSTOMER WITH WHICH SUCH SUPPLIER HAS AN AGREEMENT
 FOR PROVISION OF ELECTRICITY SERVICES AND NATURAL GAS SERVICES.
   § 2. This act shall take effect immediately.
