BILL NUMBER: S1144 PURPOSE : To promote school safety by providing retired police officers with peace officer status when they are employed by a school district as a school resource officer. SUMMARY OF PROVISIONS : Section 1. Amends section 2.10 of the criminal procedure law by expanding the definition of peace officer to include retired police officers employed by a school district as a school resource officer. Section 2. This act shall take effect immediately. JUSTIFICATION : School resource officers are great assets to school districts striving to enhance school safety. School resource officers are not just hired guards; they collaborate with educators, parents, and children to develop educational programs, prevent drug abuse, and minimize violence. They are educators, law enforcers, and counselors. Police officers are ideal for this job, because their specialized knowledge enhances a school's environmental safety planning and facilities management, school-safety policy, and emergency response preparedness.

RETIRED POLICE OFFICERS EMPLOYED BY A SCHOOL DISTRICT AS A SCHOOL RESOURCE OFFICER; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. § 2.
