 TITLE OF BILL :

An act to amend the mental hygiene law, in relation to the
prescription of antidepressant and anti-anxiety medications which have
an increased risk of suicidal behavior

 PURPOSE :

Provides that no antidepressant or anti-anxiety medication prescribed
in an outpatient setting which has an increased risk of suicidality
shall be dispensed for a first-time patient, before having first had a
consultation with supporting educational literature

 SUMMARY OF PROVISIONS :

Section 1 is amended by adding a new section 7.49, to include several
instructions regarding the dispensing of an antidepressant or
anti-anxiety medication with suicidal tendencies as an undesired side
effect. During the required consultation, pharmacists will provide
literature with the toll-free suicide prevention telephone number,
suicide prevention website and an information pamphlet drafted by the
Department of Mental Health. Other provisions include Requirement of
parent or guardian if prescribed patient is under 17 and permission to
the Department to regulate and prepare all material.

Section 2: Effective Date.

 JUSTIFICATION :

Each year the Centers for Disease Control and Prevention collect data
regarding mortality in the United States, including deaths by suicide.
In 2010, 38,364 suicides were reported. In that year, someone in the
country died by suicide ever 13.7 minutes.

Suicidal tendencies are increasing as a potential side effect in many
prescriptions -- those that can cause an individual's personality and
physical well-being to negatively change.

By educating the patient as well as kin upon prescription pickup, this
legislation aims to save the lives of individuals who perhaps
otherwise would have taken their life.

 AN ACT to amend the mental hygiene law, in relation to the  prescription
   of antidepressant and anti-anxiety medications which have an increased
   risk of suicidal behavior

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The mental hygiene law is amended by adding a  new  section
 7.49 to read as follows:
 § 7.49 ANTIDEPRESSANT AND ANTI-ANXIETY MEDICATIONS; SUICIDE RISK.
   (A)  WHEN  A  PATIENT RECEIVES A PRESCRIPTION FOR AN ANTIDEPRESSANT OR
 ANTI-ANXIETY MEDICATION IN AN OUTPATIENT SETTING, AND THE MEDICATION HAS
 AN INCREASED RISK OF SUICIDALITY, THE OFFICE SHALL IDENTIFY SUCH MEDICA-
 TIONS AND SHALL REQUIRE PHARMACISTS IN THE COURSE OF CONSULTATION,  UPON
 THE  FIRST  TIME DISPENSING OF THE MEDICATION TO THE PATIENT, TO PROVIDE
 THE FOLLOWING:
   (1) THE TOLL-FREE SUICIDE PREVENTION LIFELINE TELEPHONE NUMBER  ESTAB-
 LISHED BY THE OFFICE;
   (2)  THE  SUICIDE  PREVENTION LIFELINE WEBSITE INTERNET ADDRESS ESTAB-
 LISHED BY THE OFFICE; AND
   (3) A PAMPHLET PUBLISHED BY THE  OFFICE  SETTING  FORTH  ALL  RELEVANT
 INFORMATION  REGARDING  THE  INCREASED RISK OF SUICIDE AND SUICIDAL SIDE
 EFFECTS ASSOCIATED WITH THE MEDICATION, INCLUDING, BUT NOT  LIMITED  TO,
 INFORMATION  SETTING  FORTH  THE  WARNING  SIGNS  ASSOCIATED  WITH  SUCH
 SUICIDAL BEHAVIOR AND ANY OTHER INFORMATION THE OFFICE DEEMS RELEVANT.
   (B) ANY CONSULTATION REQUIRED BY SUBDIVISION (A) OF THIS SECTION  WITH
 A  PERSON  UNDER  SEVENTEEN  YEARS OF AGE SHALL REQUIRE THAT A PARENT OR
 LEGAL GUARDIAN OF SUCH PERSON BE IN ATTENDANCE DURING SUCH CONSULTATION.
   (C) NO MEDICATION DESCRIBED IN SUBDIVISION (A) OF THIS  SECTION  SHALL
 BE  DISPENSED,  DISPERSED OR OTHERWISE GIVEN TO A PERSON UNDER SEVENTEEN
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

 YEARS OF AGE UNLESS A PARENT OR LEGAL GUARDIAN  OF  SUCH  PERSON  IS  IN

   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law; provided, however, that  effective  immediately,  the
 addition,  amendment  and/or  repeal of any rule or regulation necessary
 for the implementation of this act on its effective date  is  authorized
 to be made and completed on or before such date.

creation of education materials regarding the potential side effects
on dispensing of an antidepressant or anti-anxiety medication with an
increased risk of side effects. During the required consultation,
pharmacists will provide literature drafted by the Department of
Mental Health in consultation with other state agencies.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The mental hygiene law is amended by adding a  new  section
 7.49 to read as follows:
 § 7.49 ANTIDEPRESSANT AND ANTI-ANXIETY MEDICATIONS.
   (A) THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH,
 SHALL  CREATE  OR  UTILIZE  EXISTING EDUCATIONAL MATERIALS REGARDING THE
 POTENTIAL SIDE EFFECTS WITH USE OF ANTIDEPRESSANTS OR ANTI-ANXIETY MEDI-
 CATION.
   (B) SUCH MATERIALS SHALL BE MADE AVAILABLE TO PHARMACIES REGISTERED IN
 THE STATE, AND SHALL BE DISTRIBUTED AT THE TIME OF DISPENSING  WITH  ANY
 PRESCRIBED DRUG THAT IS IDENTIFIED BY THE DEPARTMENT OF HEALTH AS HAVING
 AN  INCREASED  RISK  OF SIDE EFFECTS WHEN USED. INFORMATION DISSEMINATED
 PURSUANT TO THIS SUBDIVISION MAY, AT THE  OPTION  OF  THE  CONSUMER,  BE
 DISTRIBUTED THROUGH ELECTRONIC MEANS.
   (C)  SUCH  MATERIAL SHALL ALSO BE POSTED ON THE WEBSITES OF THE OFFICE
 AND THE DEPARTMENT OF HEALTH AND SHALL BE  PROVIDED  IN  LANGUAGE  OTHER
 THAN  ENGLISH  AS  DEEMED  APPROPRIATE  BY  THE COMMISSIONERS, BUT SHALL
 INCLUDE THE TEN MOST COMMONLY SPOKEN LANGUAGES, ASIDE FROM  ENGLISH,  IN
 THE STATE.
   (D)  THE  MATERIALS  REQUIRED IN SUBDIVISION (A) OF THIS SECTION SHALL
 INCLUDE THE FOLLOWING:
   (1) THE SUICIDE PREVENTION LIFELINE TELEPHONE NUMBER;
   (2) THE SUICIDE PREVENTION WEBSITE;

   (3) RELEVANT INFORMATION ABOUT ANTIDEPRESSANTS AND ANTI-ANXIETY  MEDI-
 CATIONS  AND  POTENTIAL  SIDE  EFFECTS  OF THE MEDICATION AS WELL AS THE
 PHYSICAL, BEHAVIORAL AND ADVANCED WARNING SIGNS OF SUICIDE; AND
   (4) SUCH OTHER INFORMATION AS THE COMMISSIONER AND THE COMMISSIONER OF
 THE DEPARTMENT OF HEALTH SHALL DETERMINE TO BE NECESSARY OR INFORMATIVE.
   (E)  THE OFFICE IS AUTHORIZED AND DIRECTED TO PROMULGATE ANY RULES AND
 REGULATIONS AND PREPARE PAMPHLETS NECESSARY TO IMPLEMENT THE  PROVISIONS
 OF THIS SECTION.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law; provided, however, that  effective  immediately,  the
 addition,  amendment  and/or  repeal of any rule or regulation necessary
 for the implementation of this act on its effective date are  authorized
