                                 BILL NUMBER:  S4019

 TITLE OF BILL :  An act to amend the vehicle and traffic law, in
relation to establishing a distinctive "Jamaican bobsled team" number
plate

 PURPOSE :

The purpose of this legislation is to allow the issuance of a
distinctive Jamaican Bobsled team member plate of a design developed
and approved by the commissioner, in cooperation with Jamaica Bobsled
foundation.

 SUMMARY OF PROVISIONS :

Section one of the bill adds § 404-y to the vehicle and traffic law to
provide any resident of New York State to, upon request, be issued a
distinctive "Jamaican Bobsled team" number plate of a design developed
and approved by the commissioner in cooperation with the Jamaican
Bobsled Foundation. The distribution of a "Jamaican Bobsled team"
number plate shall be issued in the same manner as other number plates
upon the payment of regular registration fees. An annual service
charge of twenty-five dollars will be charged for such a plate and
will be deposited pursuant to the provisions of section four hundred
four-oo to the plate development fund of the department of motor
vehicles. The State Comptroller shall pay annual service charges

collected in excess of six thousand dollars to the Jamaica Bobsled
Foundation. Section two of the bill provides the effective date.

 EXISTING LAW :

None

 JUSTIFICATION :

The Jamaican Bobsled team was first formed in preparation for the 1988
Winter Olympics in Calgary, Alberta. They were immediately seen as
popular underdogs being from a tropical island and competing in a
notorious winter sporting event. The Jamaican Bobsled legacy continues
after several more appearances in subsequent Winter Olympics and
stunned many of their critics by finishing in 14th place in the 1994
Olympic Games, finishing ahead of Russia, the United States,
Australia, and France. The creation and sale of a "Jamaica Bobsled
team" designed license plate would benefit the team as it aims to
generate support and popularity through the promotion with proceeds
going towards the Jamaican Bobsled Foundation spearheaded by Executive
Director, Noel Spencer, and one of the inaugural Olympic team members,
Devon Harris.  With many Jamaican immigrants residing in the New York,
the establishment of this plate would provide residents an opportunity
to support and fund the country's team in its training and journey
back to the Olympics.

 AN ACT to amend the vehicle and traffic law, in relation to establishing
   a distinctive "Jamaican bobsled team" number plate
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  vehicle  and  traffic law is amended by adding a new
 section 404-y to read as follows:
   § 404-Y. DISTINCTIVE "JAMAICAN BOBSLED TEAM"  NUMBER  PLATES.  1.  ANY
 PERSON  RESIDING IN THIS STATE SHALL, UPON REQUEST, BE ISSUED A DISTINC-
 TIVE "JAMAICAN BOBSLED TEAM" NUMBER PLATE  OF  A  DESIGN  DEVELOPED  AND
 APPROVED  BY  THE  COMMISSIONER, IN COOPERATION WITH THE JAMAICA BOBSLED
 FOUNDATION.  APPLICATION FOR SUCH NUMBER SHALL BE FILED WITH THE COMMIS-
 SIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE.
   2. A DISTINCTIVE "JAMAICAN BOBSLED TEAM" NUMBER PLATE ISSUED  PURSUANT
 TO  THIS  SECTION  SHALL  BE  ISSUED  IN THE SAME MANNER AS OTHER NUMBER
 PLATES UPON THE PAYMENT OF THE REGULAR REGISTRATION  FEE  PRESCRIBED  BY
 SECTION  FOUR  HUNDRED  ONE  OF THIS ARTICLE, PROVIDED, HOWEVER, THAT AN
 ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-FIVE DOLLARS SHALL BE CHARGED
 FOR SUCH PLATE.  SUCH ANNUAL SERVICE CHARGE SHALL BE DEPOSITED  PURSUANT
 TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-OO OF THIS ARTICLE TO THE
 CREDIT OF THE DEPARTMENT OF MOTOR VEHICLES DISTINCTIVE PLATE DEVELOPMENT
 FUND  ESTABLISHED BY SECTION NINETY-FIVE-G OF THE STATE FINANCE LAW, AND
 SHALL BE USED FOR THE PRODUCTION, DESIGN, ADVERTISING AND  MARKETING  OF
 DISTINCTIVE  LICENSE  PLATES  PURSUANT  TO  SUCH  SECTION NINETY-FIVE-G;
 PROVIDED, HOWEVER, THAT ANNUAL SERVICE CHARGES COLLECTED  IN  EXCESS  OF
 SIX  THOUSAND  DOLLARS  SHALL  BE  PAID  BY THE STATE COMPTROLLER TO THE
 JAMAICA BOBSLED FOUNDATION.
   § 2. This act shall take effect immediately.

PURPOSE:

The purpose of this legislation is to allow for the issuance of a
distinctive Jamaican Bobsled team number plate of a design developed and
approved by the commissioner.

 
SUMMARY OF PROVISIONS:

Section one of the bill adds § 404-z to the vehicle and traffic law
authorizing the issuance of distinctive "Jamaican Bobsled team" license
plates. Subdivision one provides that any resident of New York State to,
upon request, be issued a distinctive "Jamaican Bobsled team" license
plate of a design developed and approved by the commissioner. Subdivi-
sion two provides that the distribution of a "Jamaican Bobsled team"

license plate shall be issued in the same manner as other number plates
upon the payment of regular registration fees and an additional annual
$25.00 fee.

Section two of the bill provides that a distinctive plate shall only be
designed, produced, and issued upon the delivery of a surety bond in the
amount of $6,000 or at least 200 orders for such distinctive plate with
the additional one-time service charge applicable to each order. All of
the service charges will be deposited into the DMV distinctive place
development fund. The language also provides that if after two years
following the date upon which the plate is first made available for
sale, 200 or more sets of plates are sold, and the bond shall be discon-
tinued. If fewer than 200 plates are sold within the first 2 years, the
DMV shall be entitled to recover against the bond in the amount propor-
tionate to the short fall.

Section three of the bill provides the effective date.

and directed to be made and completed on or before such effective date.

 AN ACT to amend the vehicle and traffic law, in relation to establishing
   a distinctive "Jamaican bobsled team" number plate
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The vehicle and traffic law is  amended  by  adding  a  new
 section 404-ee to read as follows:
   §  404-EE.  DISTINCTIVE  "JAMAICAN BOBSLED TEAM" NUMBER PLATES. 1. ANY
 PERSON RESIDING IN THIS STATE SHALL, UPON REQUEST, BE ISSUED A  DISTINC-
 TIVE  "JAMAICAN  BOBSLED TEAM" LICENSE PLATE OF A DESIGN APPROVED BY THE
 COMMISSIONER.  APPLICATION FOR SAID LICENSE PLATE SHALL  BE  FILED  WITH
 THE  COMMISSIONER  IN  SUCH  FORM  AND  DETAIL AS THE COMMISSIONER SHALL
 PRESCRIBE.
   2. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED
 IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT  OF  THE  REGULAR
 REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE,
 PROVIDED,  HOWEVER,  THAT AN ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-
 FIVE DOLLARS SHALL BE CHARGED FOR SUCH PLATE.
   § 2. 1. A distinctive plate established pursuant to section 404-ee  of
 the  vehicle  and  traffic law as added by section one of this act shall
 only be designed, produced and issued upon the delivery to  the  depart-
 ment  of  motor  vehicles of a surety bond in the amount of six thousand
 dollars, which shall be executed by a surety company authorized  by  the
 department  of  financial  services  to transact business in this state.
 Provided, however, that if the commissioner of motor vehicles shall have
 received prior to plate design, production and  issuance  at  least  two
 hundred  orders  for such distinctive plate together with the additional

 annual service charge applicable to each  such  order,  which  shall  be
 non-refundable,  no  such  surety  bond  shall  be required. All service
 charges collected pursuant to this section shall be  deposited  pursuant
 to  the  provisions  of section 404-oo of the vehicle and traffic law to
 the credit of the department of motor vehicles distinctive plate  devel-
 opment  fund  established  by  section 95-g of the state finance law and
 shall be used for the design, production, advertising  and  distribution
 of distinctive license plates in accordance with such section 95-g.
   2.  If, upon the expiration of two years following the date upon which
 distinctive plates in the  series  are  first  available  for  sale  two
 hundred  or more sets of such plates are sold, a bond delivered pursuant
 to this section shall be discontinued. If fewer than two hundred sets of
 such plates are sold by such time,  the  department  of  motor  vehicles
 shall be entitled to recover against the bond in an amount proportionate
 to such shortfall.
   §  3.  This act shall take effect immediately; provided, however, that
 section one of this act shall take effect on the one  hundred  eightieth
 day  after  it shall have become a law. Effective immediately, the addi-
 tion, amendment and/or repeal of any rule or  regulation  necessary  for
 the  implementation of this act on its effective date are authorized and
 directed to be made and completed on or before such effective date.
