BILL NUMBER: S5317 TITLE OF BILL : An act to amend the executive law, in relation to the report submitted by the division of service-disabled veterans' business development PURPOSE : This bill amends the annual reporting requirement due from the division of service-disabled veterans' business development, so that the report is parallel to the report that is issued for the utilization of minority-women business enterprises. SUMMARY OF SPECIFIC PROVISIONS : Section one amends subdivision (4)(f) of Executive Law section 369-i, to require that the division of service-disabled veterans' business development issue a complete report, indicating utilization rates by each agency, department, division and office which is subject to the service-disabled veteran owned business act. Section two provides that this act shall take effect immediately. JUSTIFICATION : This bill would amend the annual reporting requirement on the status

CROCI -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT to amend the executive law, in relation to the report submitted by the division of service-disabled veterans' business development THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 4 of section 369-i of the executive law is REPEALED and a new paragraph (f) is added to read as follows: (F) SUBMIT A REPORT ON DECEMBER THIRTY-FIRST OF EACH YEAR, TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY AND THE CHAIRPERSONS OF THE SENATE FINANCE AND ASSEMBLY WAYS AND MEANS COMMITTEES ON THE LEVEL OF SERVICE-DISABLED VETERAN-OWNED BUSINESSES PARTICIPATING IN EACH AGENCY'S CONTRACTS FOR GOODS AND SERVICES AND ON ACTIVITIES OF THE DIVISION AND EFFORT BY EACH CONTRACT- ING AGENCY TO PROMOTE UTILIZATION OF SERVICE-DISABLED VETERAN-OWNED BUSINESSES, AND TO PROMOTE AND INCREASE PARTICIPATION BY CERTIFIED SERVICE-DISABLED VETERAN-OWNED BUSINESSES WITH RESPECT TO STATE CONTRACTS AND SUBCONTRACTS SO AS TO FACILITATE THE AWARD OF A FAIR SHARE OF STATE CONTRACTS TO SUCH BUSINESSES. THE COMPTROLLER SHALL ASSIST THE DIVISION IN COLLECTING INFORMATION ON THE PARTICIPATION OF CERTIFIED BUSINESSES FOR EACH CONTRACTING AGENCY. SUCH REPORT MAY RECOMMEND NEW ACTIVITIES AND PROGRAMS TO EFFECTUATE THE PURPOSES OF THIS ARTICLE. § 2. This act shall take effect immediately; provided, however, that the amendments made to paragraph (f) of subdivision 4 of section 369-i of article 17-B of the executive law, made by section one of this act, shall not affect the repeal of such article and shall be deemed repealed therewith. CROCI, HELMING -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Home- land Security and Military Affairs -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and delivered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the executive law, in relation to the report submitted by the division of service-disabled veterans' business development THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 4 of section 369-i of the executive law, as added by chapter 22 of the laws of 2014, is amended to read as follows: (f) Submit a report by the thirty-first of December each year, [with the first report due by the thirty-first of December in the calendar year next succeeding the calendar year in which this article shall have become a law,] to the governor, the temporary president of the senate, [and] the speaker of the assembly AND THE CHAIRPERSONS OF THE SENATE FINANCE AND ASSEMBLY WAYS AND MEANS COMMITTEES. Such report shall include information including, but not limited to, the number of contracts entered into pursuant to this article, the average amount of such contracts, the number of service-disabled veteran-owned business enterprises certified, the number of applications for certification as a service-disabled veteran-owned business enterprise, the number of denials for such certification, the number of appeals of such denials, and the outcome of such appeals and the average time that is required for such certification to be completed. ALSO TO BE INCLUDED SHALL BE THE LEVEL OF SERVICE-DISABLED VETERAN-OWNED BUSINESSES PARTICIPATING IN EACH AGENCY'S CONTRACTS FOR GOODS AND SERVICES AND ON ACTIVITIES OF THE DIVI- SION AND EFFORTS BY EACH CONTRACTING AGENCY TO PROMOTE UTILIZATION OF EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
