BILL NUMBER: S5658 TITLE OF BILL : An act to repeal section 2-126 of the election law, relating to party funds and restrictions on expenditures SUMMARY OF PROVISIONS : This bill repeals section 2-126 of the election law which prohibits the expenditure of party funds in primary elections. The section has been declared unconstitutional *and the State Board of Elections in enjoined from enforcing the provision. JUSTIFICATION : Election Law 2-126 has been declared unconstitutional; and the State Board of Elections has been enjoined from enforcing the provision since 2006 (see Matter of Avella v Batt, 33 AD3d 77 3' Dept 2006 ; Kermani v New York State Board of Elections, 487 F.Supp2d 101 NDNY 2006 ). Section 2-126 of the election law is REPEALED. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
