BILL NUMBER: S5981 TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises PURPOSE OR GENERAL IDEA OF BILL : This legislation would create an exemption for the Lewiston Fire Company Number 1 as it pertains to the 200 foot rule for on premise consumption of alcohol. SUMMARY OF SPECIFIC PROVISIONS: Section 1 allows the authority to issue a retail license for on-premise consumption for the Lewiston fire department which is located within 200 feet of a church. This section contains the appropriate designation of property for this siting. Section 2 is the effective date. JUSTIFICATION : The Lewiston Fire Company No.1 recently completed renovations to their facility including the creation of a small reception hall to be used for weddings and other events.Due to the proximity to St. Peters Church and School they are prohibited from being issued a license for on-premise consumption from the State Liquor Authority. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-9) to read as follows: (E-9) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDIVI- SION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMP- TION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP AND A SCHOOL, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE LEWISTON FIRE DEPARTMENT LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF NIAGARA, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND SITUATE IN THE VILLAGE OF LEWISTON, COUNTY OF NIAGARA AND STATE OF NEW YORK, BEING NEW LOT "C" ACCORDING TO A MAP MADE BY JAMES M. MCINTYRE, SURVEYOR, ON APRIL 8, 2011 AND FILED IN THE NIAGARA COUNTY CLERK'S OFFICE ON JUNE 13, 2012 IN BOOK 64 OF MICROFILMED MAPS, AT PAGE 6441M SHOWING RE-SUBDIVISION OF OLD SUBLOTS 169 AND 170 ON THE EAST SIDE OF THE NORTH FIFTH STREET; AND SUBLOTS 154, 155 AND 156 ON THE SOUTH SIDE OF ONONDAGA STREET AS SHOWN ON MAP OF PART 1 OF SAID VILLAGE MADE BY J.P.
