                                 BILL NUMBER:  S6081

 TITLE OF BILL :  An act to amend chapter 942 of the laws of 1983 and
chapter 541 of the laws of 1984, relating to foster family care
demonstration programs, and to amend chapter 256 of the laws of 1985,
amending the social services law and other laws relating to foster
family care demonstration programs, in relation to extending the
expirations thereof

 PURPOSE :

This legislation will extend the expiration date of the foster family
care demonstration program for an additional four years.

 SUMMARY OF PROVISIONS :

Amends various sections relating to the foster family care
demonstration programs by extending the provisions to expire December
31, 2021.

 EXISTING LAW :

Current provisions are set to expire December 31, 2017.

 JUSTIFICATION :

The authority for the foster family care demonstration program was
originally established by Chapter 942 of the laws of 1983 and chapter
541 of the laws of 1984. The program was extended over the years and
is set to expire in December 2013.

The State is constantly trying to find ways to reduce and contain
rising Medicaid costs. The foster family care demonstration program
has been one such attempt. It was established as a cost effective
community based alternative to care in a residential health care
facility. Foster family care providers serve one or two individuals
who are medically eligible for residential health care or personal
care services and who lack a home or the resources or family support
to live in the community. Caregivers provide room and board,
supervision, and assistance with personal care in their home. A
sponsoring agency supervises the care and is also responsible for
recruitment and training.

Foster family care is financed from a combination of Supplemental
Security Income (SSI) and Medicaid or private pay. The demonstration
project was originally tested in two sites, Westchester and Dutchess
counties.

Chapter 942 of the Laws of 1983 and Chapter 541 of the Laws of 1984,
authorized the continuation of these two demonstration sites and
authorized the Department to designate up to 10 additional entities to
participate. The foster family care demonstration program is an
important option in the long term care continuum that should be
extended. The program serves a distinct population in a cost-effective
manner and develops familial relationships between clients and
caregivers. It also reduces institutionalization, emergency room
visits and hospital admissions.

 AN ACT to amend chapter 942 of the laws of 1983 and chapter 541  of  the
   laws  of  1984, relating to foster family care demonstration programs,
   and to amend chapter 256 of the laws  of  1985,  amending  the  social
   services  law  and  other  laws  relating to foster family care demon-
   stration programs, in relation to extending the expirations thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 3 of chapter 942 of the laws of 1983, relating to
 foster family care demonstration programs, as amended by chapter 487  of
 the laws of 2013, is amended to read as follows:
   §  3. This act shall take effect immediately and shall expire December
 31, [2017] 2021.
   § 2. Section 3 of chapter 541 of the laws of 1984, relating to  foster
 family  care  demonstration  programs,  as amended by chapter 487 of the
 laws of 2013, is amended to read as follows:
   § 3. This section and subdivision two of section two of this act shall
 take effect immediately and the remaining provisions of this  act  shall
 take  effect  on the one hundred twentieth day next thereafter. This act
 shall expire December 31, [2017] 2021.
   § 3. Section 6 of chapter 256 of the laws of 1985, amending the social
 services law and other laws relating to foster family care demonstration
 programs, as amended by chapter 487 of the laws of 2013, is  amended  to
 read as follows:
   §  6. This act shall take effect immediately and shall expire December
 31, [2017] 2021 and upon such date the provisions of this act  shall  be
 deemed to be repealed.
   § 4. This act shall take effect immediately.
