 Introduced  by Sens. KLEIN, MARCHIONE -- read twice and ordered printed,
   and when printed to be committed to the Committee on Agriculture
 
 AN ACT to amend the agriculture and markets law, in relation to  author-
   izing the trapping, neutering or spaying, and releasing of feral cats

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 350 of the agriculture and markets law  is  amended
 by adding a new subdivision 6 to read as follows:
   6. "FERAL CAT" MEANS A DOMESTICATED CAT (FELIS CATUS) THAT WAS FORMER-
 LY  OWNED,  THAT HAS BEEN ABANDONED AND IS NO LONGER SOCIALIZED, AND ANY
 OFFSPRING OF SUCH CAT.
   § 2. The opening paragraph of  section  355  of  the  agriculture  and
 markets law is designated subdivision 1 and a new subdivision 2 is added
 to read as follows:
   2.  THE  PROVISIONS OF SUBDIVISION ONE OF THIS SECTION SHALL NOT APPLY
 TO ANY PERSON OR ENTITY WHO ABANDONS A FERAL CAT OR  CATS  AFTER  HAVING
 TRAPPED AND SPAYED OR NEUTERED SUCH CAT OR CATS.
   §  3.  The  opening  paragraph  of subdivision 5 of section 374 of the
 agriculture and markets law is designated paragraph a and  a  new  para-
 graph b is added to read as follows:
   B.  NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH A OF THIS SUBDIVISION,
 NO PROVISION OF LAW SHALL PROHIBIT ANY PERSON FROM RELEASING  ANY  FERAL
 CAT WHICH HAS BEEN TRAPPED AND SPAYED OR NEUTERED.
   § 4. This act shall take effect immediately.
