Relates to illegal dumping local enforcement grants; authorizes the commissioner to contract to make a state grant to local police agencies in conjunction with any municipal agency having authority over local sanitation or waste management for up to ninety percent of the costs to mitigate illegal dumping, not to exceed twenty-five thousand dollars for each recipient in a fiscal year.

                                 BILL NUMBER:  S6316

 TITLE OF BILL :  An act to amend the environmental conservation law,
in relation to illegal dumping local enforcement grants

 PURPOSE :

This bill would direct the Department of Environmental Conservation to
implement a grant program that assists local enforcement efforts to
combat illegal dumping.

 SUMMARY OF PROVISIONS :

Section one directs the Commissioner of the Department of
Environmental Conservation to implement an illegal dumping enforcement
grant program that provides up to $25,000 to localities to abate
illegal dumping activity.

Section two provides for eligible expenses under the grant program.

Section three requires the Commissioner, in cooperation with the
Division of State Police, to provide technical expertise and other
guidance to grantees.

Section four provides for community disclosure in instances where
surveillance cameras are installed at known dumping sites.

Section five requires grantees to update the commissioner on the
outcome of grant-funded cases upon closure.

Section six establishes the effective date.

 JUSTIFICATION :

Municipalities across New York State, and most acutely, those
communities surrounding New York City, have experienced a recent
increase in illegal dumping events within their borders.

Sadly, perpetrators who are often attempting to circumvent waste
regulations and avoid tipping fees for the proper disposal of
construction and other debris have routinely chosen parks and other
public, unmonitored spaces to illegally discard regulated waste.

Samples from large-scale dumping sites in West Hills County Park in
Mellville, NY and Roberto Clemente Park in Brentwood, NY found metals,
asbestos, polychlorinated biphenlys (PCBs), and other toxic substances
intermingled in construction and demolition debris, posing exposure
risks through inhalation and skin absorption.

Illegal dumping not only presents a public health threat and an
unnecessary drain on municipal resources, but restricts public access
to parks and other common grounds, tarnishes community character, and
can reduce local property values.

This bill would direct the Department of Environmental Conservation to
implement a grant program that provides technical assistance and
resources for interested communities to utilize prevailing illegal
dumping abatement procedures and technologies to preserve community
character, apprehend those engaged in illegal dumping and hold them
accountable.

 FISCAL IMPLICATIONS :

Subject to appropriation. A modest State investment would allow
numerous localities to access resources to mitigate illegal waste
dumping.
 EFFECTIVE DATE :
This act shall take effect immediately.

 AN ACT to amend the environmental conservation law, in relation to ille-
   gal dumping local enforcement grants
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 27-0111 to read as follows:
 § 27-0111. ILLEGAL DUMPING LOCAL ENFORCEMENT GRANTS.
   1.  THE  COMMISSIONER IS AUTHORIZED TO CONTRACT TO MAKE A STATE GRANT,
 WITHIN THE LIMIT OF APPROPRIATION THEREFOR, TO LOCAL POLICE AGENCIES  IN
 CONJUNCTION  WITH ANY MUNICIPAL AGENCY HAVING AUTHORITY OVER LOCAL SANI-
 TIZATION OR WASTE MANAGEMENT FOR UP TO NINETY PERCENT OF  THE  COSTS  TO
 MITIGATE ILLEGAL DUMPING, NOT TO EXCEED TWENTY-FIVE THOUSAND DOLLARS FOR
 EACH RECIPIENT IN A FISCAL YEAR.
   2. ELIGIBLE COSTS MAY INCLUDE, BUT SHALL NOT BE LIMITED TO:
   (A)  THE  PURCHASE AND INSTALLATION OF SURVEILLANCE CAMERAS TRAINED ON
 KNOWN ILLEGAL DUMPING SITES;
   (B) PERSONAL AND NON-PERSONAL SERVICE COSTS ASSOCIATED WITH CONDUCTING
 STING OPERATIONS AT KNOWN ILLEGAL DUMPING SITES; AND
   (C) ILLEGAL DUMPING LOCATION SURVEYS, MAPPING AND OTHER  INVESTIGATORY
 DATA COLLECTION.
   3. THE COMMISSIONER, IN COOPERATION WITH THE DIVISION OF STATE POLICE,
 SHALL  PROVIDE TECHNICAL EXPERTISE TO GRANT AWARDEES TO IMPLEMENT STAND-
 ARDS OF EVIDENCE AND PROSECUTION, DEVELOP STRATEGIES TO  COMBAT  ILLEGAL
 DUMPING  USING  SURVEILLANCE  CAMERAS  AND STING OPERATIONS, AND DEVELOP
 GUIDELINES TO PROTECT PERSONAL PRIVACY  WHILE  CARRYING  OUT  ACTIVITIES
 FUNDED THROUGH LOCAL ILLEGAL DUMPING ENFORCEMENT GRANTS.
   4.  WHERE SURVEILLANCE CAMERAS ARE INSTALLED, LOCAL POLICE AGENCIES OR
 MUNICIPAL AGENCIES RECEIVING GRANT FUNDING SHALL NOTIFY, IN WRITING, ALL
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

 RESIDENTS WITHIN A  ONE-QUARTER  MILE  AREA  OF  SUCH  INSTALLATION  AND
 SURVEILLANCE CAMERA USE.
   5.  GRANT  RECIPIENTS SHALL REPORT TO THE COMMISSIONER ON THE OUTCOMES
 OF CASES INVOLVING GRANT FUNDED SURVEILLANCE AND  CESSATION  OF  ILLEGAL
 DUMPING OPERATIONS WITHIN FORTY-FIVE DAYS OF CLOSURE.
   § 2. This act shall take effect immediately.
