BILL NUMBER: S6463 TITLE OF BILL : An act to amend the environmental conservation law, in relation to establishing an implementation and effectiveness task force to study compliance with electronic equipment recycling and reuse requirements PURPOSE : Establishes a taskforce on the effectiveness and implementation of the Electronic Waste Recycling and Reuse Program SUMMARY OF PROVISIONS : Establishes a task force convened by the Commissioner of the Department of Environmental Conservation to study the implementation and effectiveness of Title 26 of Article 27 of this chapter, the Electronic Equipment Recycling and Reuse Law. ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to establishing an implementation and effectiveness task force to study compliance with electronic equipment recycling and reuse requirements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 27-2622 to read as follows: § 27-2622. IMPLEMENTATION AND EFFECTIVENESS TASK FORCE. 1. NOT LESS THAN NINETY DAYS AFTER THE EFFECTIVE DATE OF THIS SECTION, THE COMMISSIONER SHALL CONVENE A TASK FORCE TO STUDY THE IMPLEMENTATION AND EFFECTIVENESS OF THIS TITLE. THE TASK FORCE SHALL STUDY ISSUES INCLUDING BUT NOT LIMITED TO: (A) THE AMOUNT OF ELECTRONIC WASTE RECYCLED IN THE STATE AND PROPENSI- TY OF CONSUMER ELECTRONIC WASTE ITEMS TO BE PROPERLY RECYCLED OR REUSED AS REQUIRED UNDER THIS TITLE; (B) THE COMPLIANCE WITH THIS TITLE OF BOTH CONSUMERS AND MANUFACTURERS IN RECYCLING AND REUSING CONSUMER-GENERATED WASTE; (C) THE WAYS IN WHICH MUNICIPALITIES HAVE ADAPTED WASTE SERVICE TO ALLOW FOR ELECTRONIC WASTE RECYCLING IN FURTHERANCE OF THIS TITLE, INCLUDING WHETHER MUNICIPALITIES HAVE INCLUDED OR EXCLUDED CURBSIDE ELECTRONIC WASTE COLLECTION AS A RESULT OF THE ENACTMENT OF THIS SECTION; AND (D) WHETHER ADDITIONAL LEGISLATION IS NEEDED TO MORE FULLY ENSURE COMPLIANCE AND EFFECTIVE IMPLEMENTATION OF THIS TITLE. 2. THE TASK FORCE SHALL COMPLETE A REPORT NO LATER THAN ONE YEAR AFTER THE EFFECTIVE DATE OF THIS SECTION ANNOUNCING ITS FINDINGS AND RECOMMEN- DATIONS PURSUANT TO SUBDIVISION ONE OF THIS SECTION AND THE COMMISSIONER SHALL TRANSMIT SUCH REPORT TO THE TEMPORARY PRESIDENT OF THE SENATE, SPEAKER OF THE ASSEMBLY, MINORITY LEADER OF THE SENATE, MINORITY LEADER EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
