BILL NUMBER: S6791 TITLE OF BILL : An act to amend the education law, in relation to requiring persons applying for a certificate or license to be a teacher to receive a passing score on the academic literacy skills test and the teacher performance assessment PURPOSE : This legislation requires applicants seeking teacher certification to pass the academic literacy skills test and the teacher performance assessment. SUMMARY OF PROVISIONS : Section 1: Adds a new subdivision 1-b to section 3004 of the Education Law by requiring applicants who seek a teacher certification to achieve a passing score on the academic literacy skills test and the teacher performance assessment. It prohibits the Education Commissioner from accepting alternatives to a passing score on these teacher certification assessments. Section 2: nullifies any regulation providing a multiple measures review process, any equivalency measures, or any safety net measures

S T A T E O F N E W Y O R K ________________________________________________________________________ 6791 2017-2018 Regular Sessions I N S E N A T E June 18, 2017 ___________ Introduced by COMMITTEE ON RULES -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to requiring persons applying for a certificate or license to be a teacher to receive a passing score on the academic literacy skills test and the teacher performance assessment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3004 of the education law is amended by adding a new subdivision 1-b to read as follows: 1-B. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE COMMISSIONER SHALL REQUIRE ALL PERSONS APPLYING, ON OR AFTER JANUARY FIRST, TWO THOU- SAND EIGHTEEN, FOR A CERTIFICATE OR LICENSE TO BE A TEACHER, IN ADDITION TO ALL THE OTHER CERTIFICATION OR LICENSURE REQUIREMENTS, TO RECEIVE A PASSING SCORE ON THE ACADEMIC LITERACY SKILLS TEST AND THE TEACHER PERFORMANCE ASSESSMENT. THE COMMISSIONER SHALL NOT PROVIDE A MULTIPLE MEASURES REVIEW PROCESS, ANY EQUIVALENCY MEASURES OR ANY SAFETY NET MEASURES IN LIEU OF SECURING A PASSING SCORE ON THE ACADEMIC LITERACY SKILLS TEST OR THE TEACHER PERFORMANCE ASSESSMENT. § 2. Any regulation providing a multiple measures review process, any equivalency measures, or any safety net measures for applicants who fail to achieve a passing score on the academic literacy skills test or the teacher performance assessment are null and void. § 3. This act shall take effect immediately; provided, however, that section one of this act shall be deemed to have been in full force and effect on or after March 13, 2017.
