BILL NUMBER: S6916 SPONSOR: JACOBS TITLE OF BILL: An act to amend the state administrative procedure act, in relation to increasing the revised rule public comment period from thirty days to forty-five days PURPOSE: The purpose of this bill is to amend the State Administrative Procedure Act (SAPA), to allow more time to comment on proposed rules that agen- cies have revised. SUMMARY OF PROVISIONS: Section 1: Amends the State Administrative Procedure Act (SAPA) Section 202, subdivision 4-a, requiring state agencies to allow for 45-days, instead of 30-days, public comment when the agency revises a rule proposal.

JACOBS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the state administrative procedure act, in relation to increasing the revised rule public comment period from thirty days to forty-five days THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 4-a of section 202 of the state administrative procedure act, as amended by chapter 396 of the laws of 1993, is amended to read as follows: (a) Except with respect to any rule defined in subparagraph (ii) of paragraph (a) of subdivision two of section one hundred two of this chapter, prior to the adoption of a rule, an agency shall submit a notice of revised rule making to the secretary of state for publication in the state register for any proposed rule which contains a substantial revision. The public shall be afforded an opportunity to submit comments on the revised text of a proposed rule. Unless a different time is spec- ified in statute, the notice of revised rule making must appear in the state register at least [thirty] FORTY-FIVE days prior to the adoption of the rule. The notice of revised rule making shall indicate the last date for submission of comments on the revised text of the proposed rule, which, unless a different time is specified in statute, shall be not less than [thirty] FORTY-FIVE days after the date of publication of such notice. § 2.
