TITLE OF BILL:  An act to amend a chapter of the laws of 2017, relat-
ing to establishing a temporary state commission to study child abuse
and neglect prevention, as proposed in legislative bills numbers S. 233A
and A. 5769A, in relation to establishing a temporary state taskforce to
study child abuse and neglect prevention

 
PURPOSE:

The purpose of this bill is to rename the temporary state commission on
child abuse and neglect prevention; increases the number of members of
the taskforce; includes an evaluation of primary prevention programs and
extends the timeframe to complete the report.

 
SUMMARY OF PROVISIONS:

The bill amends the name from the Temporary State Commission on Child
Abuse and Neglect Prevention to The Temporary State Taskforce on Child
Abuse and Neglect Prevention; the bill increases the members of the

taskforce from 9 to 13 members; includes evaluation of primary
prevention programs; and extends the timeframe to complete the report.

JUSTIFICATION:

Amendments were made to clarify the name the of taskforce; to specif-
ically include primary prevention programs as part of the evaluation;
and provide additional time for the taskforce to complete the report.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that section
one of this act shall take effect on the same date and in the same
manner as a Chapter of the laws of 2017, establishing a temporary state
commission to study child abuse and neglect prevention, as proposed in
legislative bills numbers S. 233A and A.  5769A, takes effect.

 AN ACT to amend a chapter of the laws of 2017, relating to  establishing
   a  temporary  state  commission  to  study  child  abuse  and  neglect
   prevention, as proposed in legislative bills numbers S.  233A  and  A.
   5769A,  in  relation  to  establishing  a temporary state taskforce to
   study child abuse and neglect prevention
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Sections  1,  2,  3, 4, and 5 of a chapter of the laws of
 2017, establishing a temporary state commission to study child abuse and
 neglect prevention, as proposed in legislative bills numbers S. 233A and
 A. 5769A, are amended to read as follows:
   Section 1. A temporary state [commission] TASKFORCE on child abuse and
 neglect prevention is hereby established to examine, evaluate  and  make
 recommendations concerning child abuse and neglect prevention efforts in
 the  state  with  the goal of preventing child removals, lowering foster
 care placements and increasing family reunification.
   § 2. The [commission]  TASKFORCE  shall  consist  of  [nine]  THIRTEEN
 members,  with  adequate  geographic  representation, to be appointed as
 follows: [three] SEVEN members to be appointed by  the  governor;  three
 members  to  be  appointed by the temporary president of the senate; and
 three members to be appointed  by  the  speaker  of  the  assembly.  The
 members shall have demonstrated experience and expertise in the field of
 child  abuse  and  neglect  prevention.  The members of the [commission]
 TASKFORCE shall receive no compensation for their services, but shall be
 reimbursed for their actual  and  necessary  expenses  incurred  in  the
 performance of their duties under this act.
   §  3.  The [commission] TASKFORCE shall meet and may hold public hear-
 ings, and may undertake any studies, inquiries, surveys or  analyses  it
 deems relevant in cooperation with or by agreement with any other public
 or private agency.

   §  4.  The  [commission]  TASKFORCE  shall  focus on issues related to
 improving the delivery of prevention programs statewide,  including  but
 not limited to an examination of the following:
   (a)  best  practices  that  have demonstrated outcomes in lowering the
 rate of child abuse and neglect;
   (b) best practices for identifying and engaging families  successfully
 in prevention programs, INCLUDING PRIMARY PREVENTION PROGRAMS;
   (c) the availability of quality prevention programs, INCLUDING PRIMARY
 PREVENTION  PROGRAMS, statewide, including the identification of regions
 where such programs are lacking;
   (d) the availability [and adequacy] of  state  funds  for  prevention,
 INCLUDING  PRIMARY PREVENTION, including where those funds are allocated
 and how they are being utilized; and
   (e) the extent to which local social services  districts  are  funding
 prevention   programs,  INCLUDING  PRIMARY  PREVENTION  PROGRAMS,  on  a
 regional basis, and identification of impediments to local funding.
   § 5. The [commission] TASKFORCE shall make a report of its findings to
 the governor, the temporary president of the senate and the  speaker  of
 the assembly no later than [one year] TWO YEARS after the effective date
 of this act. Such report shall include any recommendations for any regu-
 latory  or  statutory  changes,  or  changes  in  funding for prevention
 programs.
   § 2. Section 6 of a chapter of the laws of 2017, establishing a tempo-
 rary state commission to study child abuse and  neglect  prevention,  as
 proposed  in  legislative bills numbers S. 233A and A. 5769A, is amended
 to read as follows:
   § 6. This act shall take effect immediately and shall  expire  and  be
 deemed repealed [two] THREE years after such effective date.
   §  3.  This act shall take effect immediately; provided, however, that
 section one of this act shall take effect on the same date  and  in  the
 same  manner  as a chapter of the laws of 2017, establishing a temporary
 state commission  to  study  child  abuse  and  neglect  prevention,  as
 proposed  in  legislative  bills  numbers  S.  233A  and A. 5769A, takes
 effect.
