Authorizes the division of minority and women's business development to accept the DD Form 214 issued by the United States department of defense upon retirement, separation, or discharge from active duty in the armed forces of the United States as proof of the race or ethnicity of an applicant and of certain personal information for purposes of certification of the applicant's business as a minority-owned business.

   printed to be committed to the Committee on Finance
 
 AN ACT to amend the executive law, in relation to authorizing the  divi-
   sion  of  minority  and  women's business development to accept the DD
   Form 214 issued by  the  United  States  department  of  defense  upon
   retirement,  separation,  or  discharge  from active duty in the armed
   forces of the United States as proof of  the  race  or  ethnicity  and
   certain  personal  information of an applicant for purposes of certif-
   ication of the applicant's business as a minority-owned business
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 314 of the executive law is amended by adding a new
 subdivision 2-b to read as follows:
   2-B.  THE  DIRECTOR  SHALL ESTABLISH A PROCEDURE ENABLING AN APPLICANT
 WHO WAS A MILITARY SERVICE MEMBER TO PROVE HIS OR HER RACE OR ETHNICITY,
 DATE OF BIRTH, PLACE OF BIRTH AND VERIFICATION OF ADDRESS  FOR  PURPOSES
 OF  CERTIFICATION  OF THE APPLICANT'S BUSINESS AS A MINORITY-OWNED BUSI-
 NESS BY SUBMISSION OF THE DD FORM 214 ISSUED TO  THE  APPLICANT  BY  THE
 UNITED  STATES  DEPARTMENT  OF DEFENSE UPON SUCH APPLICANT'S RETIREMENT,
 SEPARATION, OR DISCHARGE FROM ACTIVE DUTY IN THE  ARMED  FORCES  OF  THE
 UNITED  STATES,  PROVIDED THE DD FORM 214  CONTAINS SUCH INFORMATION, IN
 LIEU OF REQUIRING THE APPLICANT TO OTHERWISE PROVE HIS OR  HER  RACE  OR
 ETHNICITY.  THE  DIRECTOR  SHALL PROMULGATE RULES AND REGULATIONS TO SET
 FORTH CRITERIA FOR THE  ACCEPTANCE OF THE DD FORM 214 BY THE OFFICE.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law; provided, however, that the amendments to section 314
 of  the  executive  law made by section one of this act shall not affect
 the expiration of such section and shall be deemed expired therewith.
