BILL NUMBER: S7893 SPONSOR: FUNKE TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to the powers and duties of the commis- sioner PURPOSE OF THE BILL: The purpose of this bill is to authorize the Office of Parks, Recreation and Historic Preservation to enter mutual aid agreements for cross-bord- er emergency services with adjacent states and municipal subdivisions thereof, and to authorize providing services out of State under such agreements. SUMMARY OF PROVISIONS: Section 1 of the bill amends section 3.09 of the Parks, Recreation and Historic Preservation Law to add a subdivision on inter-state mutual aid agreements.

FUNKE -- (at request of the Office of Parks, Recre- ation and Historic Preservation) -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to the powers and duties of the commissioner THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3.09 of the parks, recreation and historic preser- vation law is amended by adding a new subdivision 5-a to read as follows: 5-A. BE EMPOWERED, TO ENTER INTO MUTUAL AID AND ASSISTANCE AGREEMENTS WITH OTHER STATES, EXECUTIVE AGENCIES AND POLITICAL SUBDIVISIONS OF SUCH STATES, IN CASES OF PUBLIC EMERGENCIES FOR THE HEALTH, SAFETY AND WELFARE OF THE PUBLIC USING STATE PARK FACILITIES AND IN GEOGRAPHICAL LOCATIONS IN OTHER STATES WHICH BORDER SUCH FACILITIES. SUCH MUTUAL AID AGREEMENTS MAY INCLUDE PROVISIONS FOR THE FURNISHING AND EXCHANGING OF SUPPLIES, EQUIPMENT, FACILITIES, PERSONNEL, SERVICES DURING AN EMERGEN- CY, AND FOR JOINT TRAINING EXERCISES IN PREPARATION FOR DEALING WITH EMERGENCIES. § 2.
