FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the arts and cultural affairs law, in relation to music licensing agreements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The arts and cultural affairs law is amended by adding a new title H to read as follows: TITLE H MUSIC LICENSING ARTICLE 26 MUSIC LICENSING AGREEMENTS SECTION 26.01. DEFINITIONS. 26.02. REGISTRATION OF AGREEMENTS AND MEMBERS. 26.03. REPRESENTATIVE CONDUCT. 26.04. INFORMATION. 26.05. CONTRACTS. 26.06. ENFORCEMENT. 26.07. STATUTORY CONSTRUCTION. § 26.01. DEFINITIONS. 1. AS USED IN THIS SECTION: (A) "COPYRIGHT OWNER" MEANS THE OWNER OF A COPYRIGHT OF A NONDRAMATIC MUSICAL WORK RECOGNIZED AND ENFORCEABLE UNDER THE COPYRIGHT LAWS OF THE UNITED STATES PURSUANT TO TITLE 17 OF THE UNITED STATES CODE (17 USC SEC. 101 ET SEQ.). COPYRIGHT OWNER DOES NOT INCLUDE THE OWNER OF A COPY- RIGHT IN A MOTION PICTURE OR AUDIOVISUAL WORK, OR IN PART OF A MOTION PICTURE OR AUDIOVISUAL WORK. (B) "PERFORMING RIGHTS SOCIETY" MEANS AN ASSOCIATION OR CORPORATION THAT LICENSES THE PUBLIC PERFORMANCE OF NONDRAMATIC MUSICAL WORKS ON BEHALF OF COPYRIGHT OWNERS, SUCH AS THE AMERICAN SOCIETY OF COMPOSERS, AUTHORS AND PUBLISHERS (ASCAP), BROADCAST MUSIC, INC. (BMI), AND SESAC, INC. (C) "PROPRIETOR" MEANS THE OWNER OF A RETAIL ESTABLISHMENT, RESTAU- RANT, INN, BAR, TAVERN, SPORTS OR ENTERTAINMENT FACILITY, OR ANY OTHER EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

Section 31.04 of the arts and cultural affairs law, as added by chapter 660 of the laws of 1995, is amended to read as follows: § 31.04. Copyrights. 1. As used in this section: (a) "Copyright owner" means the owner of a copyright of a nondramatic musical work recognized and enforceable under the copyright laws of the United States pursuant to Title 17 of the United States Code, Pub. L. 94-553 (17 U.S.C. § 101 et seq.). "Copyright owner" shall not include the owner of a copyright in a motion picture or audiovisual work, or in part of a motion picture or audiovisual work. (b) "Performing rights society" means an association or corporation that licenses the public performance of nondramatic musical works on behalf of copyright owners, such as the American Society of Composers, Authors and Publishers (ASCAP), Broadcast Music, Inc. (BMI), and SESAC, Inc. (c) "Proprietor" means the owner of a retail establishment, restau- rant, inn, bar, tavern, SPORTS OR ENTERTAINMENT FACILITY, or any other similar place of business or professional office located in this state in which the public may assemble and in which nondramatic musical works OR SIMILAR COPYRIGHTED WORKS may be performed, broadcast, or otherwise transmitted FOR THE ENJOYMENT OF MEMBERS OF THE PUBLIC THERE ASSEMBLED. (d) "Royalty" or "royalties" means the fees payable to a COPYRIGHT OWNER OR performing rights society for THE public performance rights OF NONDRAMATIC MUSICAL WORKS OR OTHER SIMILAR WORKS.
