BILL NUMBER: S8054 SPONSOR: LAVALLE TITLE OF BILL: An act to amend the public authorities law, in relation to authorizing towns within the service area of Long Island Power Authority to estab- lish underground utility improvement districts PURPOSE OR GENERAL IDEA OF BILL: To authorize towns within the service area of the Long Island Power Authority (LIPA) to establish underground utility improvement districts. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends Section 1020-f of the public authorities law by adding a new subdivision (ii) to authorize any town in the LIPA service area to establish an underground utility improvement district. Section 2. Effective Date.

THIELE -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to authorizing towns within the service area of Long Island Power Authority to estab- lish underground utility improvement districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1020-f of the public authorities law is amended to by adding a new subdivision (ii) to read as follows: (II) ANY TOWN IN THE SERVICE AREA IS HEREBY AUTHORIZED TO ESTABLISH AN UNDERGROUND UTILITY IMPROVEMENT DISTRICT UTILIZING THE PROVISIONS OF ARTICLES TWELVE AND TWELVE-A OF THE TOWN LAW FOR ESTABLISHMENT OF SPECIAL DISTRICTS. SUCH UNDERGROUND UTILITY IMPROVEMENT DISTRICT SHALL BE ESTABLISHED AND ADMINISTERED PURSUANT TO THE PROVISIONS OF ARTICLES TWELVE AND TWELVE-A OF THE TOWN LAW AND THE PROVISIONS OF THIS SECTION. TO THE EXTENT THAT THE PROVISIONS OF THIS SECTION SHALL IN ANY WAY TO BE IN CONFLICT WITH ARTICLES TWELVE AND TWELVE-A OF THE TOWN LAW, THE PROVISIONS OF THIS SECTION SHALL BE CONTROLLING. AFTER AN UNDERGROUND UTILITY IMPROVEMENT DISTRICT HAS BEEN ESTABLISHED, THE TOWN BOARD MAY TAKE SUCH ACTION AS MAY BE REQUIRED TO ADOPT PLANS AND SPECIFICATIONS AND ENTER INTO A CONTRACT OR CONTRACTS, OR TAKE SUCH OTHER ACTIONS AS MAY BE REQUIRED, FOR THE CONVERSION OF EXISTING OVERHEARD UTILITY FACIL- ITIES TO UNDERGROUND FACILITIES AND CONSTRUCTION OF NEW UNDERGROUND FACILITIES FOR UTILITIES. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14130-01-8
