BILL NUMBER: S8830 SPONSOR: SEWARD TITLE OF BILL: An act to amend the agriculture and markets law, the public health law and the alcoholic beverage control law, in relation to ice cream or other frozen desserts made with wine, beer or cider PURPOSE: to authorize the sale of beer and hard cider ice cream similar to wine ice cream SUMMARY OF PROVISIONS: The bill amends subdivisions 14 and 15 of Section 200 of the Agriculture and Markets Laws adding beer and cider to the law authorizing the sale of wine ice cream and frozen desserts containing alcohol between one- half to 5% alcohol content, provided only those over 21 years of age can be served or sold to and alcohol warning labels or signs are provided on

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, the public health law and the alcoholic beverage control law, in relation to ice cream or other frozen desserts made with wine, beer or cider THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 14 and 15 of section 200 of the agriculture and markets law, as amended by chapter 42 of the laws of 2011, subpara- graph (i) and the opening paragraph of subparagraph (ii) of paragraph (a) of subdivision 15 as amended by chapter 40 of the laws of 2017, are amended to read as follows: 14. If it is ice cream or other frozen desserts made with wine, BEER OR CIDER bearing or containing more than five percent of alcohol by volume. 15. With respect to the manufacture and sale of ice cream or other frozen desserts made with wine, BEER OR CIDER bearing or containing more than one-half of one percent, but not more than five percent of alcohol by volume: (a) No person shall sell at retail packages of ice cream or other frozen desserts made with wine, BEER OR CIDER for consumption off the premises where sold unless: (i) each package is a sealed package, as received from the manufactur- er or distributor; (ii) each sealed package, as received from the manufacturer or distributor, in a format to be established or approved by the commis- sioner, prominently bears the following statements, PROVIDED THAT SUCH STATEMENTS MAY REFER TO EITHER WINE, BEER OR CIDER OR A COMBINATION THEREOF: (A) The sale of this product to individuals under the age of twenty- one years is prohibited. (B) This product is made with [wine] (INSERT WINE, BEER AND/OR CIDER) and contains alcohol up to five percent by volume. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
