AN ACT legalizing, validating, ratifying and confirming certain actions
by the South New Berlin Fire District relating to the issuance of a
bond anticipation note for such district
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. It is hereby found and determined that the board of fire
commissioners of the South New Berlin Fire District, located in the town
of South New Berlin, Chenango County, undertook the following actions in
relation to the issuance of a bond anticipation note for such district:
(a) Adopted, by three-fifths majority vote of the board of fire
commissioners, a bond resolution on October 12, 2018 authorizing the
acquisition of real property and construction of new fire district
facilities thereon;
(b) Subsequent to adoption of the bond resolution by the fire district
board of commissioners, such bond resolution was approved by the elec-
tors of the fire district pursuant to a mandatory referendum on December
12, 2018;
(c) In accordance with the bond resolution the fire district issued a
bond anticipation note in the amount of $1,000,000.00 on April 8, 2019.
§ 2. All acts done and proceedings heretofore had and taken or caused
to be had and taken by the South New Berlin Fire District board of
commissioners, and by all officers, employees or agents of such fire
district relating to or in connection with the bond issuance described
in section one of this act, is hereby legalized, validated, ratified and
confirmed, notwithstanding any failure or defect of the district to
comply with sections 38.00 of the local finance law and 179 of the town
law relating to the date on which the referendum vote for such bond
issuance was held.
§ 3. This act shall take effect immediately.
