S T A T E O F N E W Y O R K ________________________________________________________________________ 10702 I N A S S E M B L Y July 1, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Joyner) -- read once and referred to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to expanding the func- tions of the chief administrator of the courts to include the compila- tion of certain data with respect to ethnicity, race, disability, veteran status, gender, gender identity, and sexual orientation by specific jurisdiction and submit an annual report of his or her find- ings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 212 of the judiciary law is amended by adding a new paragraph (y) to read as follows: (Y) COLLECT, COMPILE, AND PUBLISH STATISTICS AND OTHER DEMOGRAPHIC DATA PROVIDED IN ACCORDANCE WITH SUBPARAGRAPH (I) OF THIS PARAGRAPH AND SUBMIT ANNUALLY, ON OR BEFORE THE FIFTEENTH DAY OF MARCH, TO THE LEGIS- LATURE AND THE GOVERNOR A REPORT OF HIS OR HER FINDINGS. (I) THE CHIEF ADMINISTRATOR SHALL ANNUALLY REQUEST THAT EACH JUDGE AND JUSTICE OF THE STATE-PAID COURTS OF THE UNIFIED COURT SYSTEM DISCLOSE TO THE OFFICE OF COURT ADMINISTRATION INFORMATION AS TO HIS OR HER RACE/ETHNICITY, SEX, SEXUAL ORIENTATION, GENDER IDENTITY, VETERAN STATUS, AND DISABILITY STATUS. COMPLIANCE WITH THIS REQUEST BY A JUDGE OR JUSTICE SHALL BE ENTIRELY VOLUNTARY; AND ANY INFORMATION DISCLOSED TO THE OFFICE OF COURT ADMINISTRATION MAY ONLY BE RELEASED PUBLICLY IN THE FORM OF AGGREGATED STATISTICAL DATA THAT DOES NOT IDENTIFY A JUSTICE OR JUDGE. (II) THE REPORT REQUIRED BY THIS PARAGRAPH SHALL INCLUDE SEPARATE CHARTS SHOWING THE RACE/ETHNICITY, SEX, SEXUAL ORIENTATION, GENDER IDEN- TITY, DISABILITY STATUS AND VETERAN STATUS OF: (A) ALL RESPONDING JUDGES AND JUSTICES OF THE UNIFIED COURT SYSTEM, INCLUDING SUB-CHARTS FOR ALL ELECTED JUDGES AND JUSTICES AND ALL APPOINTED JUDGES AND JUSTICES BY APPOINTING AUTHORITY; (B) ALL RESPONDING JUDGES OF THE COURT OF APPEALS; (C) ALL RESPONDING JUSTICES OF THE APPELLATE DIVISION, INCLUDING SUB- CHARTS FOR APPELLATE DIVISION JUSTICES IN EACH APPELLATE DEPARTMENT; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
