 AN ACT to amend the mental hygiene law, in relation to  requiring  emer-
   gency  services  facilities  to provide immediate suicide risk assess-
   ments to acute psychiatric patients
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The mental hygiene law is amended by adding a new section
 33.29 to read as follows:
 § 33.29 EMERGENCY SERVICES FACILITIES IMMEDIATE  ASSESSMENT  OF  SUICIDE
           RISK.
   (A)  FOR  PURPOSES  OF  THIS  SECTION, "EMERGENCY SERVICES FACILITIES"
 SHALL MEAN BUILDINGS, STRUCTURES, EQUIPMENT OR SYSTEMS USED  TO  PROVIDE
 EMERGENCY  MEDICAL SERVICES TO INDIVIDUALS WHO REQUIRE IMMEDIATE MEDICAL
 ATTENTION.
   (B) EMERGENCY SERVICES FACILITIES SHALL PROVIDE FOR, AS PART OF  THEIR
 PATIENT  INTAKE  PROCESS, THE IMMEDIATE ASSESSMENT OF SUICIDE RISK IN AN
 ACUTE PSYCHIATRIC PATIENT WHO ARRIVES TO SUCH FACILITY  SEEKING  MEDICAL
 ATTENTION.
   (C)  EMERGENCY  SERVICES  FACILITIES  SHALL MAINTAIN A LICENSED MENTAL
 HEALTH PROFESSIONAL OR EMERGENCY SERVICES PERSONNEL WHO  HAVE  COMPLETED
 COURSEWORK  OR  APPLIED  EXPERIENCE  UNDER  SUPERVISION  IN SUICIDE RISK
 ASSESSMENT AND INTERVENTION ON STAFF AND AVAILABLE DURING ALL  HOURS  OF
 OPERATION  IN  ORDER  TO PROVIDE FOR THE IMMEDIATE ASSESSMENT OF SUICIDE
 RISK AS DESCRIBED IN SUBDIVISION (B) OF THIS SECTION.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.
