Prohibits school districts from requiring annual performance reviews of classroom teachers and building principals during the 2020-2021 school year and ensures that funds for the general support of public schools for which a school district is otherwise entitled shall not be withheld; a board of education or the trustees of a common school district may, upon agreement, continue to appoint on tenure classroom teachers and building principals notwithstanding that their annual professional performance review for the 2020-2021 school year has not been completed.

S T A T E O F N E W Y O R K ________________________________________________________________________ 10922 I N A S S E M B L Y August 17, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Paulin) -- read once and referred to the Committee on Education AN ACT to prohibit school districts from requiring annual professional performance reviews of classroom teachers and building principals during the 2020-2021 school year; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, school districts shall not be required to complete annual professional perform- ance reviews of classroom teachers and building principals during the 2020-2021 school year due to the state disaster emergency declared pursuant to executive order 202 of 2020 and any apportionment of funds for the general support of public schools for which a school district is otherwise entitled shall not be withheld due to a school district not submitting documentation to the commissioner of education demonstrating that the school district has fully implemented the standards and proce- dures for conducting annual teacher and principal evaluations of teach- ers and principals in accordance with the requirements of section 3012-d of the education law and the regulations issued by the commissioner of education. § 2. Notwithstanding any other provision of law, a board of education or the trustees of a common school district, only upon specific agree- ment, may appoint on tenure those classroom teachers and building prin- cipals recommended by the superintendent of schools who are in the final year of the probationary period, have received the previous requisite annual professional performance review ratings pursuant to section 3012-d of the education law and would have been in their discretion qualified for appointment on tenure based upon past performance, notwithstanding that their annual professional performance review had not been completed and they had not received the necessary effectiveness rating for the 2020-2021 school year, or such board of education or trustees of a common school district may extend such determination for an additional year. § 3. This act shall take effect immediately and shall expire and be deemed repealed June 30, 2021.
