 AN  ACT  to  amend  the penal law, in relation to prohibiting fraudulent
   absentee ballot drop-off boxes or receptacles
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1. The penal law is amended by adding a new section 190.90 to
 read as follows:
 § 190.90 ABSENTEE BALLOT DROP-OFF FRAUD.
   A PERSON OR ENTITY, OTHER THAN THE NEW YORK STATE BOARD OF  ELECTIONS,
 THE  NEW YORK CITY BOARD OF ELECTIONS OR A COUNTY BOARD OF ELECTIONS, IS
 GUILTY OF ABSENTEE BALLOT DROP-OFF FRAUD  WHEN  SUCH  PERSON  OR  ENTITY
 ERECTS,  DISPLAYS OR MAINTAINS AN ABSENTEE BALLOT DROP-OFF BOX OR RECEP-
 TACLE.
   ABSENTEE BALLOT DROP-OFF FRAUD IS A CLASS E FELONY.
   § 2. This act shall take effect immediately.

 BLY, DO ENACT AS FOLLOWS:

   § 17-172. ABSENTEE BALLOT DROP-OFF FRAUD.  ANY PERSON OR ENTITY, OTHER
 THAN THE BOARD OF ELECTIONS, WHO ERECTS, DISPLAYS OR MAINTAINS AN ABSEN-
 TEE BALLOT DROP-OFF BOX OR RECEPTACLE IS GUILTY OF A FELONY.
