 AN ACT to amend the public health law, in relation  to  availability  of
   air  transport  ambulance  service  providers  to store and distribute
   blood
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  The  public health law is amended by adding a new section
 3003-e to read as follows:
   § 3003-E. AVAILABILITY OF AIR TRANSPORT AMBULANCE SERVICE PROVIDERS TO
 STORE AND DISTRIBUTE BLOOD. 1. ANY AMBULANCE PROVIDER AS LICENSED PURSU-
 ANT TO THIS ARTICLE THAT  PROVIDES  AIR  TRANSPORT  SERVICES,  SHALL  BE
 AUTHORIZED  TO  STORE HUMAN BLOOD AT ALL THEIR FACILITIES AND DISTRIBUTE
 HUMAN BLOOD WHILE PROVIDING AIR TRANSPORT SERVICES;  PROVIDED,  HOWEVER,
 THE ONLY PERSONNEL ON THE AIRCRAFT THAT SHALL DISTRIBUTE THE HUMAN BLOOD
 WHEN TRANSPORTING A PATIENT VIA THE AIRCRAFT SHALL BE A REGISTERED NURSE
 WHO  IS  CURRENTLY LICENSED TO PRACTICE AS A REGISTERED NURSE WITHIN THE
 STATE.
   2. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR  REGULATION  TO
 THE  CONTRARY, ANY AMBULANCE PROVIDER AS LICENSED PURSUANT TO THIS ARTI-
 CLE THAT PROVIDES AIR TRANSPORT SERVICES,  SHALL  STORE  AND  DISTRIBUTE
 HUMAN  BLOOD IN ACCORDANCE WITH THE STANDARDS SET FORTH BY SECTION THIR-
 TY-ONE HUNDRED OF THIS CHAPTER; PROVIDED, HOWEVER, AN AMBULANCE PROVIDER
 SHALL MEET OR EXCEED ALL STANDARDS FOR THE STORAGE OF BLOOD PRODUCTS SET
 FORTH BY THE UNITED STATES FOOD AND DRUG ADMINISTRATION, AND RECOMMENDED
 BY AN INTERNATIONALLY RECOGNIZED, NOT-FOR-PROFIT ASSOCIATION  REPRESENT-
 ING  INDIVIDUALS  AND INSTITUTIONS INVOLVED IN THE FIELDS OF TRANSFUSION
 MEDICINE AND CELLULAR THERAPIES.
   § 2. This act shall take effect immediately.
