AN ACT to amend the personal property law, in relation to the assessment
of excess wear and damage to a leased motor vehicle upon termination
of the lease
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 4 of section 343 of the personal property law
is amended by adding a new paragraph (d) to read as follows:
(D) IN THE EVENT THAT THE HOLDER IMPOSES A CHARGE FOR EXCESS WEAR AND
DAMAGE TO THE VEHICLE AND SUCH CHARGE IS PAID BY THE LESSEE, THE HOLDER
SHALL ENSURE THAT ALL REPAIRS OR REPLACEMENT OF ITEMS FOR WHICH THE
LESSEE WAS CHARGED SHALL BE REPAIRED OR REPLACED PRIOR TO THE SALE OF
THE VEHICLE.
§ 2. This act shall take effect immediately.
