 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation  to the authority of enforcement officers to issue violations
   relating to removal of commercial waste

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  16-116 of the administrative code of the city of
 New York is amended by adding a new subdivision e to read as follows:
   E. ANY NOTICE OF VIOLATION, APPEARANCE TICKET OR SUMMONS ISSUED FOR  A
 VIOLATION  OF  SUBDIVISION  A OR B OF THIS SECTION MAY BE ISSUED WITHOUT
 SUCH VIOLATION BEING COMMITTED WITHIN THE ENFORCEMENT OFFICER'S PRESENCE
 WHEN SUCH OFFICER HAS REASONABLE CAUSE TO BELIEVE THAT THE VIOLATION WAS
 COMMITTED BY THE OWNER, LESSEE OR PERSON  IN  CONTROL  OF  A  COMMERCIAL
 ESTABLISHMENT.
   § 2. This act shall take effect immediately.
