 AN ACT to amend chapter 674 of the laws of 2007, amending  the  environ-
   mental  conservation  law,  relating to creating the New York invasive
   species council, in relation to establishing a pilot grant program  in
   Erie county to explore the effectiveness of tree removal in combatting
   the spread of emerald ash borer
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Chapter 674 of the laws of 2007, amending the environmental
 conservation law, relating to creating the  New  York  invasive  species
 council, is amended by adding a new section 1-a to read as follows:
   § 1-A. 1. THE NEW YORK INVASIVE SPECIES COUNCIL, AS DEFINED IN SECTION
 9-1705  OF  THE ENVIRONMENTAL CONSERVATION LAW, SHALL ADMINISTER A PILOT
 GRANT PROGRAM IN ERIE COUNTY, IN AN AMOUNT NOT TO  EXCEED  $250,000,  TO
 EXPLORE  THE  EFFECTIVENESS  OF TREE REMOVAL IN COMBATTING THE SPREAD OF
 EMERALD ASH BORER. PILOT PROGRAM GRANTS WILL BE PROVIDED TO  THE  COUNTY
 FOR  THE  REIMBURSEMENT OF REASONABLE COSTS INCURRED BY LOW-INCOME HOME-
 OWNERS, IN AN AMOUNT NOT TO EXCEED $250  PER  TREE,  AND  A  MAXIMUM  OF
 $1,000  PER  PROPERTY,  FOR  THE  REMOVAL OF TREES KILLED OR INFECTED BY
 EMERALD ASH BORERS, IN A MANNER DETERMINED  BY  THE  NEW  YORK  INVASIVE
 SPECIES  COUNCIL  TO  MINIMIZE  THE  RISK  OF  FURTHER EMERALD ASH BORER
 CONTAMINATION. GRANTS MAY ONLY BE PROVIDED IN CASES WHERE SUCH  DEAD  OR
 INFECTED TREES REPRESENT AN IMMINENT DANGER.
   2.  NO LATER THAN MARCH 1, 2022, THE NEW YORK INVASIVE SPECIES COUNCIL
 SHALL ISSUE A REPORT TO THE LEGISLATURE DETAILING  THE  RESULTS  OF  THE
 PILOT GRANT PROGRAM.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law.
