Relates to excepting certain persons or entities from indemnity bonds or insurance policy requirements when renting or leasing rental vehicles to film or television production companies; provides that rental car companies are not subject to certain corporate surety bond or liability insurance coverage requirements when renting to a film or television production company when such production company purchases insurance that complies with surety bond or insurance requirements.

 AN  ACT  to  amend the vehicle and traffic law, in relation to excepting
   certain persons or entities from indemnity bonds or  insurance  policy
   requirements  when renting or leasing rental vehicles to film or tele-
   vision production companies

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  opening paragraph of subdivision 3 of section 370 of
 the vehicle and traffic law, as amended by chapter 232 of  the  laws  of
 2001, is amended to read as follows:
   A  person, firm, association or corporation engaged in the business of
 renting or leasing rental vehicles to be operated upon the public  high-
 ways  for carrying passengers shall be subject to the provisions of this
 section in the same manner and to the same extent  as  if  such  person,
 firm,  association  or corporation were actually engaged in the business
 of carrying or transporting passengers for hire; PROVIDED, HOWEVER,  ANY
 PERSON,  FIRM,  ASSOCIATION  OR  CORPORATION  ENGAGED IN THE BUSINESS OF
 RENTING OR LEASING RENTAL VEHICLES TO ANY FILM OR TELEVISION  PRODUCTION
 COMPANY  SHALL  NOT BE SUBJECT TO THE CORPORATE SURETY BOND OR LIABILITY
 INSURANCE COVERAGE REQUIREMENTS OF THIS SECTION, PROVIDED  SUCH  PERSON,
 FIRM,  ASSOCIATION  OR  CORPORATION FILES WITH THE COMMISSIONER OF MOTOR
 VEHICLES, IN SUCH FORM AS THE COMMISSIONER MAY PRESCRIBE, EVIDENCE  THAT
 SUCH  FILM  OR  TELEVISION  PRODUCTION COMPANY HAS PURCHASED A POLICY OF
 INSURANCE ON SUCH RENTED OR LEASED RENTAL VEHICLES  THAT  COMPLIES  WITH
 THE  REQUIREMENTS  OF  THIS  SECTION.  FOR THE PURPOSES OF THIS SECTION,
 "FILM OR TELEVISION PRODUCTION COMPANY" MEANS  A  CORPORATION,  PARTNER-
 SHIP, LIMITED PARTNERSHIP, OR OTHER ENTITY OR INDIVIDUAL WHICH OR WHO IS
 PRINCIPALLY  ENGAGED  IN  THE PRODUCTION OF A FEATURE-LENGTH FILM, TELE-
 VISION FILM, TELEVISION  PILOT  AND/OR  EACH  EPISODE  OF  A  TELEVISION
 SERIES,  REGARDLESS  OF  THE MEDIUM BY MEANS OF WHICH THE FILM, PILOT OR
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
