Relates to requiring businesses to meet certain green requirements to be eligible for the START-UP NY program; businesses operating in newly constructed buildings shall be powered by at least thirty-five percent alternative energy; businesses operating in already existing buildings shall utilize at least forty-five percent less electricity than neighboring businesses of similar size and business type.

   MONTESANO, WALKER -- read  once  and  referred  to  the  Committee  on
   Economic Development
 
 AN  ACT  to amend the economic development law, in relation to requiring
   businesses to meet certain green requirements to be eligible  for  the
   START-UP NY program

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section 433 of  the  economic  development
 law is amended by adding a new paragraph (h) to read as follows:
   (H)  IF  A BUSINESS IS OR WILL BE OPERATING OUT OF A NEWLY CONSTRUCTED
 BUILDING THE BUSINESS SHALL DEMONSTRATE THAT IT WILL, WITHIN  ITS  FIRST
 YEAR  OF  OPERATION  AS  A  PARTICIPANT  IN  THE START-UP NY PROGRAM, BE
 POWERED BY AT LEAST THIRTY-FIVE PERCENT  ALTERNATIVE  ENERGY  INCLUDING,
 BUT  NOT LIMITED TO, WIND ENERGY, SOLAR ENERGY AND GEOTHERMAL ENERGY. IF
 A BUSINESS IS OR WILL BE OPERATING OUT OF AN ALREADY EXISTING  BUILDING,
 SUCH BUSINESS SHALL, WITHIN ITS FIRST YEAR OF OPERATION AS A PARTICIPANT
 IN  THE  START-UP  NY  PROGRAM, UTILIZE AT LEAST FORTY-FIVE PERCENT LESS
 ELECTRICITY THAN NEIGHBORING BUSINESSES OF  SIMILAR  SIZE  AND  BUSINESS
 TYPE WHO ARE NOT PART OF THE START-UP NY PROGRAM.
   § 2. This act shall take effect immediately.
