 AN ACT to amend the education law, in relation to requiring recess every
   day for elementary school students
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The education law is amended by adding a new section 817 to
 read as follows:
   §  817.  RECESS.  EACH  SCHOOL  SHALL  REGULARLY  SCHEDULE A TIME OF A
 REASONABLE LENGTH WITHIN EACH SCHOOL DAY FOR EACH FULL DAY PUPIL ATTEND-
 ING PRE-KINDERGARTEN THROUGH GRADE SIX TO ENGAGE IN PHYSICAL ACTIVITY IN
 AN UNSTRUCTURED FREE PLAY SESSION MONITORED BY A STAFF OF SCHOOL EMPLOY-
 EES OR VOLUNTEERS.
   § 2. This act shall take effect on the first of July  after  it  shall
 have become a law.
