 AN ACT to amend the education law, in relation to defining need-resource
   capacity; and in relation to authorizing and directing the commission-
   er of education to examine current wealth  and  student  need  factors
   used to calculate foundation aid

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section  3602  of  the  education  law  is
 amended by adding a new paragraph ii to read as follows:
   II.  "NEED-RESOURCE  CAPACITY" AS DETERMINED PURSUANT TO CLAUSE (C) OF
 SUBPARAGRAPH TWO OF PARAGRAPH C OF SUBDIVISION SIX OF THIS  SECTION  FOR
 THE  SCHOOL AID COMPUTER LISTING PRODUCED BY THE COMMISSIONER IN SUPPORT
 OF THE ENACTED BUDGET FOR THE TWO  THOUSAND  SEVEN--TWO  THOUSAND  EIGHT
 SCHOOL  YEAR AND ENTITLED "SA0708", SHALL MEAN AN INDEX DEVELOPED BY THE
 COMMISSIONER USED TO CATEGORIZE SCHOOL  DISTRICTS  INTO  SIMILAR  SCHOOL
 DISTRICTS.    SUCH  INDEX  SHALL  BE  UPDATED  ON AN ANNUAL BASIS BY THE
 COMMISSIONER. FURTHER, IF SUCH INDEX IS USED FOR SCHOOL  DISTRICT  ALLO-
 CATION  PURPOSES,  SUCH  INDEX  MUST  BE  UPDATED ANNUALLY AND USED IN A
 SCHOOL AID COMPUTER LISTING IN SUPPORT OF AN ENACTED BUDGET.
   § 2. The commissioner of education is hereby authorized  and  directed
 to examine the current wealth and student need factors used to calculate
 foundation  aid  under  section  3602 of the education law and prepare a
 report of recommendations that would ensure a  more  accurate  represen-
 tation of district and student need for use in such education aid formu-
 la.  Provided  further,  in developing such recommendations, the commis-
 sioner of education shall examine other reliable  measures  of  district
 need  and student poverty. The report shall be submitted to the director
 of the budget, the chairs of the senate finance committee, the  assembly
 ways and means committee, the senate education committee, and the assem-
 bly education committee on or before October 1, 2021.
   § 3. This act shall take effect immediately.
