 AN ACT to amend the multiple dwelling law, the  multiple  residence  law
   and  the  executive  law,  in  relation  to requiring renewable energy
   devices to be installed in all new multi-family  homes  and  apartment
   buildings

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The multiple dwelling  law  is  amended  by  adding  a  new
 section 85 to read as follows:
   §  85. RENEWABLE ENERGY DEVICES. ANY CONSTRUCTION OF A MULTIPLE DWELL-
 ING COMMENCED ON OR AFTER  JANUARY  FIRST,  TWO  THOUSAND  TWENTY  SHALL
 INCLUDE  A  RENEWABLE  ENERGY  DEVICE WHICH EITHER GENERATES OR SAVES ON
 AVERAGE ONE HUNDRED KILOWATT-HOURS PER MONTH PER DWELLING  UNIT  INCLUD-
 ING,  BUT NOT LIMITED TO, GEOTHERMAL HEATING AND COOLING SYSTEMS, GEOTH-
 ERMAL POWER GENERATION, AND SOLAR CAPTURE SYSTEMS.
   § 2. The multiple residence law is amended by adding a new section 175
 to read as follows:
   § 175. RENEWABLE ENERGY DEVICES. ANY CONSTRUCTION OF A MULTIPLE DWELL-
 ING COMMENCED ON OR AFTER  JANUARY  FIRST,  TWO  THOUSAND  TWENTY  SHALL
 INCLUDE  A  RENEWABLE  ENERGY  DEVICE WHICH EITHER GENERATES OR SAVES ON
 AVERAGE ONE HUNDRED KILOWATT-HOURS PER MONTH PER DWELLING  UNIT  INCLUD-
 ING,  BUT NOT LIMITED TO, GEOTHERMAL HEATING AND COOLING SYSTEMS, GEOTH-
 ERMAL POWER GENERATION, AND SOLAR CAPTURE SYSTEMS.
   § 3. Section 378 of the executive law  is  amended  by  adding  a  new
 subdivision 19 to read as follows:
   19.  ANY  CONSTRUCTION OF ANY BUILDING WITH MULTIPLE UNITS FOR RENT OR
 SALE COMMENCED ON OR AFTER JANUARY  FIRST,  TWO  THOUSAND  TWENTY  SHALL
 INCLUDE  A  RENEWABLE  ENERGY  DEVICE WHICH EITHER GENERATES OR SAVES ON
 AVERAGE ONE HUNDRED KILOWATT-HOURS PER MONTH PER DWELLING  UNIT  INCLUD-
 ING,  BUT NOT LIMITED TO, GEOTHERMAL HEATING AND COOLING SYSTEMS, GEOTH-
 ERMAL POWER GENERATION, AND SOLAR CAPTURE SYSTEMS.
   § 4. This act shall take effect immediately.
