 AN ACT to amend the public health law, in relation  to  authorizing  the
   use  of  monies by enforcement officers for tobacco enforcement activ-
   ities related to enforcement of a local law which restricts the age of
   purchase for tobacco products up to the age of twenty-one years old
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subdivision 3 of section 1399-hh of the public health law,
 as added by chapter 433 of the laws of  1997,  is  amended  to  read  as
 follows:
   3.  Monies  made  available  to  enforcement officers pursuant to this
 section shall only be used  for  local  tobacco  enforcement  activities
 approved by the commissioner; PROVIDED, HOWEVER, THAT MONIES MAY BE USED
 BY  ENFORCEMENT  OFFICERS  FOR TOBACCO ENFORCEMENT ACTIVITIES RELATED TO
 ENFORCEMENT OF A LOCAL LAW WHICH  RESTRICTS  THE  AGE  OF  PURCHASE  FOR
 TOBACCO PRODUCTS UP TO THE AGE OF TWENTY-ONE YEARS OLD.
   §  2.  This  act shall take effect immediately. Effective immediately,
 the addition, amendment and/or repeal of any rule or  regulation  neces-
 sary  for  the  implementation  of  this  act  on its effective date are
 authorized to be made on or before such date.
