Relates to consecutive sentencing for certain crimes that occur at a place of religious worship; requires consecutive sentencing for homicide convictions that occur in any building, structure or upon the curtilage of such building or structure used as a place of religious worship by a religious corporation, as incorporated under the religious corporations law or the education law.

 AN ACT to amend the penal law, in relation to consecutive sentencing for
   certain crimes that occur at a place of religious worship
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 2 of section 70.25 of the penal law, as amended
 by chapter 56 of the laws of 1984, is amended to read as follows:
   2. When more than one sentence of imprisonment is imposed on a  person
 for  two or more offenses committed through a single act or omission, or
 through an act or omission  which  in  itself  constituted  one  of  the
 offenses  and  also  was a material element of the other, the sentences,
 except if one or more of such sentences is for a  violation  of  section
 270.20  of  this chapter, must run concurrently; PROVIDED, HOWEVER, THAT
 SENTENCES SHALL RUN CONSECUTIVELY WHENEVER  (A)  ONE  OR  MORE  OF  SUCH
 SENTENCES IS FOR A CONVICTION UNDER SECTION 125.10 (CRIMINALLY NEGLIGENT
 HOMICIDE),  SECTION  125.11  (AGGRAVATED CRIMINALLY NEGLIGENT HOMICIDE),
 SECTION 125.12 (VEHICULAR MANSLAUGHTER IN THE  SECOND  DEGREE),  SECTION
 125.13  (VEHICULAR  MANSLAUGHTER  IN  THE  FIRST DEGREE), SECTION 125.14
 (AGGRAVATED VEHICULAR HOMICIDE), SECTION  125.15  (MANSLAUGHTER  IN  THE
 SECOND  DEGREE),  SECTION  125.20  (MANSLAUGHTER  IN  THE FIRST DEGREE),
 SECTION 125.21 (AGGRAVATED MANSLAUGHTER IN THE SECOND  DEGREE),  SECTION
 125.22  (AGGRAVATED  MANSLAUGHTER  IN  THE FIRST DEGREE), SECTION 125.25
 (MURDER IN THE SECOND DEGREE), SECTION 125.26  (AGGRAVATED  MURDER),  OR
 SECTION 125.27 (MURDER IN THE FIRST DEGREE) OF THIS CHAPTER; AND (B) THE
 ACT  OR  OMISSION OCCURRED IN ANY BUILDING, STRUCTURE OR UPON THE CURTI-
 LAGE OF SUCH BUILDING OR STRUCTURE USED AS A PLACE OF RELIGIOUS  WORSHIP
 BY  A  RELIGIOUS CORPORATION, AS INCORPORATED UNDER THE RELIGIOUS CORPO-
 RATIONS LAW OR THE EDUCATION LAW.
   § 2. This act shall take effect on the first of November next succeed-
 ing the date upon which it shall have become a law.
