AN ACT directing the department of environmental conservation to conduct
a study on the life cycle of battery use and disposal; directing such
department to develop options and recommendations for a battery recy-
cling collection program and a battery recycling outreach and educa-
tion program; and providing for the repeal of such provisions upon
expiration thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The department of environmental conservation is authorized
and directed to conduct a study on the life cycle of battery use and
disposal.
§ 2. The scope of the study shall include, but not be limited to:
(a) environmentally sound battery recycling practices;
(b) existing battery recycling programs;
(c) funding of a battery recycling program, with consideration for
battery producers funding the program;
(d) current hazardous waste plans;
(e) methods of battery collection which includes an emphasis on
convenience for customers;
(f) analysis of statewide, local, or joint governance over a battery
recycling collection program;
(g) transportation of batteries recycled through a battery recycling
collection program;
(h) how to implement a battery recycling collection program throughout
the state given its varied population densities; and
(i) the use of battery stewardship organizations in a battery recycl-
ing collection program.

§ 3. The department of environmental conservation shall provide a
report to the governor and the legislature on or before January 1, 2021.
Such report shall include:
(a) an analysis of options for a battery recycling collection program
which include transparent reporting and performance goals for responsi-
ble parties;
(b) an analysis of options for a battery recycling outreach and educa-
tion program; and
(c) recommendations on both battery recycling collection programs and
battery recycling outreach and education programs.
§ 4. This act shall take effect immediately and shall expire and be
deemed repealed April 1, 2021.
