 AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
   prohibiting certain frozen beverages containing alcohol
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The alcoholic beverage control law is amended by  adding  a
 new section 132 to read as follows:
   §  132.  PROHIBITING  CERTAIN FROZEN BEVERAGES CONTAINING ALCOHOL.  IT
 SHALL BE UNLAWFUL TO SELL, OFFER FOR SALE EITHER IN  PERSON  OR  ONLINE,
 DELIVER  OR  GIVE  AWAY  ANY  FROZEN  BEVERAGE CONTAINING ALCOHOL, SUGAR
 AND/OR ARTIFICIAL SWEETENER IN THIS STATE  WITHOUT  PRIOR  AUTHORIZATION
 FROM THE STATE LIQUOR AUTHORITY.
   THE PROVISIONS OF THIS SECTION SHALL APPLY TO BEVERAGES DENOMINATED AS
 "PHROSTIES" AND SUCH SIMILAR BEVERAGES.
   § 2. This act shall take effect immediately.
