 AN ACT to amend the executive law and the insurance law, in relation  to
   prohibiting  gender discrimination in motor vehicle insurance rates or
   rating classifications
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The executive law is amended by adding a new section 296-e
 to read as follows:
   § 296-E. UNLAWFUL DISCRIMINATORY PRACTICES IN RELATION TO MOTOR  VEHI-
 CLE  INSURANCE.  IT SHALL BE AN UNLAWFUL DISCRIMINATORY PRACTICE FOR ANY
 PERSON, CORPORATION, ASSOCIATION OR OTHER BUSINESS ENTITY AUTHORIZED  TO
 ISSUE  A  MOTOR  VEHICLE  INSURANCE POLICY IN THIS STATE TO ESTABLISH OR
 MAINTAIN RATES OR RATING CLASSIFICATIONS  FOR  MOTOR  VEHICLE  INSURANCE
 BASED ON THE SEX OF THE DRIVER INSURED.
   §  2. The insurance law is amended by adding a new section 323 to read
 as follows:
   § 323. PROHIBITION OF GENDER DISCRIMINATION.  (A) FOR PURPOSES OF THIS
 SECTION, THE TERM "INSURER" SHALL MEAN ANY PERSON, CORPORATION,  ASSOCI-
 ATION  OR  OTHER  BUSINESS  ENTITY  AUTHORIZED  TO ISSUE A MOTOR VEHICLE
 INSURANCE POLICY IN THIS STATE.
   (B) AN INSURER SHALL NOT ESTABLISH OR MAINTAIN RATES OR RATING CLASSI-
 FICATIONS FOR MOTOR VEHICLE INSURANCE BASED ON THE  SEX  OF  THE  DRIVER
 INSURED.
   § 3. This act shall take effect immediately.
