 AN ACT to amend the general municipal  law  in  relation  to  disability
   retirement  for  persons  receiving  benefits from the victims compen-
   sation fund for the terrorist attacks occurring on September eleventh,
   two thousand one

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  general  municipal  law  is  amended by adding a new
 section 207-r to read as follows:
   § 207-R. PERFORMANCE OF DUTY  DISABILITY  RETIREMENT.  NOTWITHSTANDING
 THE  PROVISIONS  OF  ANY GENERAL, SPECIAL OR LOCAL LAW OR ADMINISTRATIVE
 CODE TO THE CONTRARY, BUT  EXCEPT  FOR  THE  PURPOSES  OF  THE  WORKERS'
 COMPENSATION  LAW  AND  THE  LABOR  LAW,  A  MEMBER OF THE NEW YORK CITY
 EMPLOYEE RETIREMENT SYSTEM WHO HAS PREVIOUSLY RECEIVED BENEFITS FROM THE
 VICTIMS COMPENSATION FUND FOR THE TERRORIST ATTACKS OCCURRING ON SEPTEM-
 BER ELEVENTH, TWO THOUSAND ONE, WHO COMPLETES AN APPLICATION  FOR  DISA-
 BILITY  RETIREMENT SHALL BE PRESUMED TO HAVE SUCH DISABILITY AS A RESULT
 OF THE PERFORMANCE OR DISCHARGE OF HIS OR HER DUTIES, UNLESS THE CONTRA-
 RY BE PROVED BY COMPETENT EVIDENCE. SUCH DISABILITY RETIREMENT SHALL  BE
 APPROVED  UNLESS  IT IS PROVED SUCH MEMBER OF THE NEW YORK CITY EMPLOYEE
 RETIREMENT SYSTEM HAS NOT RECEIVED BENEFITS  FROM  THE  VICTIMS  COMPEN-
 SATION  FUND  FOR THE TERRORIST ATTACKS OCCURRING ON SEPTEMBER ELEVENTH,
 TWO  THOUSAND ONE.
   § 2. This act shall take effect immediately.
