 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   requiring products containing glyphosate to have a warning label
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 37-0115 to read as follows:
 § 37-0115. PRODUCTS CONTAINING GLYPHOSATE; WARNING LABEL.
   1.  ANY  PRODUCT  CONTAINING GLYPHOSATE WHICH IS DISTRIBUTED, SOLD, OR
 OFFERED FOR SALE OR USE IN THE STATE SHALL  HAVE  A  LABEL  CLEARLY  AND
 CONSPICUOUSLY  STATING  THAT  SUCH  PRODUCT CONTAINS GLYPHOSATE AND THAT
 GLYPHOSATE MAY BE CARCINOGENIC.
   2. FOR THE PURPOSES OF THIS SECTION, GLYPHOSATE SHALL MEAN A SYNTHETIC
 COMPOUND THAT IS A  NON-SELECTIVE  SYSTEMIC  HERBICIDE,  ALSO  KNOWN  AS
 N-(PHOSPHONOMETHYL) GLYCERINE WITH A CHEMICAL FORMULA OF C3H8NO5P.
   3.  THE  DEPARTMENT  IS  AUTHORIZED TO PROMULGATE SUCH RULES AND REGU-
 LATIONS AS IT SHALL DEEM NECESSARY TO IMPLEMENT THE PROVISIONS  OF  THIS
 SECTION.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.
