S T A T E O F N E W Y O R K ________________________________________________________________________ 8747 2019-2020 Regular Sessions I N A S S E M B L Y November 25, 2019 ___________ Introduced by M. of A. GOTTFRIED -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to the services for individuals with traumatic brain injuries in rural areas THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2745 to read as follows: § 2745. COUNTIES WITH LIMITED SERVICE CAPACITY. 1. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, THE COMMISSIONER AND THE COMMISSIONER OF DEVELOPMENTAL DISABILITIES SHALL ENTER INTO A COOPER- ATIVE AGREEMENT TO ALLOW THE INTEGRATION OF INDIVIDUALS WITH TRAUMATIC BRAIN INJURY SUSTAINED AFTER AGE TWENTY-ONE INTO PROGRAMS CERTIFIED PURSUANT TO ARTICLE SIXTEEN OF THE MENTAL HYGIENE LAW IN COUNTIES WHERE THERE IS A LACK OF APPROPRIATE SERVICES FOR INDIVIDUALS WITH TRAUMATIC BRAIN INJURY. 2. SERVICES AVAILABLE TO INDIVIDUALS WITH TRAUMATIC BRAIN INJURY SUSTAINED AFTER AGE TWENTY-ONE PURSUANT TO THIS SECTION SHALL INCLUDE, BUT NOT BE LIMITED TO, MEDICAL, HOUSING, VOCATIONAL, EDUCATIONAL, TRANS- PORTATION, SOCIAL, PERSONAL CARE, FAMILY SUPPORT, DAY PROGRAM, COMMUNITY RE-ENTRY, OUTPATIENT REHABILITATION, HABILITATION AND OTHER ESSENTIAL SERVICES. 3. FUNDING FOR SERVICES PROVIDED UNDER THIS SECTION SHALL BE PROVIDED BY DEPARTMENT OF HEALTH MEDICAID RESOURCES. § 2. This act shall take effect on the ninetieth day after it shall have become a law. Effective immediately, the addition and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
